Common use of Debarred Individuals Clause in Contracts

Debarred Individuals. The contractor shall have policies and procedures in place to routinely monitor staff positions and subcontractors for individuals debarred or excluded. The Contractor shall be required to disclose to the OMPP PI Section information required by 42 CFR 455.106 regarding the Contractor’s staff and persons with an ownership/controlling interest in the Contractor that have been convicted of a criminal offense related to that person’s involvement in Medicare/Medicaid or Title XIX programs. In accordance with 42 CFR 438.610(a)(1)-(2), 42 CFR 438.610(c)(1)-(2), 42 CFR 438.610(a)(1)-(2), 42 CFR 438.610(c)(3)-(4), Section 1932(d)(1) of the Social Security Act, SMDL 6/12/08, and SMDL 1/16/09, the Contractor must not knowingly have a relationship with the following: ▪ An individual who is (or is affiliated with a person/entity that is) debarred, suspended or otherwise excluded from participating in procurement activities under the Federal Acquisition Regulation or from participating in non-procurement activities under regulations issued under Executive Order No. 12549 or under guidelines implementing Executive Order No. 12549; and EXHIBIT 1.
