Common use of Damages for Failure to Complete Contract or Termination for Breach Clause in Contracts

Damages for Failure to Complete Contract or Termination for Breach. (a) In event of Contractor’s fail- ure to cut designated timber on portions of Contract Area by Termination Date; Contractor’s failure to complete re- quired stewardship projects by Termination Date; or termination for breach under J.3.1; Forest Service shall appraise remaining Included Timber and stewardship projects, unless termination is under I.2.2 or I.3.4. Such appraisal shall be made with the standard Forest Service method in use at time of termination.
