Common use of Damaged Cans Clause in Contracts

Damaged Cans. It is understood the driver has the duty to check a container while at the dock. If the container is found to be damaged the company agrees to make every effort to collect a payment of up to $50 from the shipping lines to the driver. The parties agree to be bound to the pending clarification award due to be handed down by Arbitrator Xxxxx Ready early in 2006, with respect to Damaged Cans, after which such clarifications shall be deemed to be part of this collective agreement.
