Damaged Cans. It is understood the driver has the duty to check a container while at the dock. If the container is found to be damaged the company agrees to make every effort to collect a payment of up to $50 from the shipping lines to the driver. The parties agree to be bound to the pending clarification award due to be handed down by Arbitrator ▇▇▇▇▇ Ready early in 2006, with respect to Damaged Cans, after which such clarifications shall be deemed to be part of this collective agreement.
