Common use of Damage Near End of Term Clause in Contracts

Damage Near End of Term. Notwithstanding any provisions of Section 6.04 to the contrary, if damage to or destruction of the Hotel occurs during the last twelve (12) months of the Term (including any exercised Renewal Term) and if such damage or destruction cannot reasonably be expected to be fully repaired and restored prior to the date that is nine (9) months prior to the end of the Term (including any exercised Renewal Term), the provisions of Section 6.04.A shall apply as if the Hotel had been totally or partially destroyed and rendered Unsuitable for Its Permitted Use.

Damage Near End of Term. Notwithstanding any provisions of Section 6.04 10.1 or 10.2 to the contrary, if damage to or destruction of the Hotel Leased Property occurs during the last twelve twenty-four (1224) months of the then Term (including any exercised Renewal Extended Term) and if such damage or destruction cannot reasonably be expected to be fully repaired and restored prior to the date that is nine twelve (912) months prior to the end of the such Term (including any exercised Renewal Extended Term), the provisions of Section 6.04.A 10.2.1 shall apply as if the Hotel Leased Property had been totally or partially destroyed and the Hotel rendered Unsuitable for Its its Permitted Use.

Damage Near End of Term. 10.3.1 Notwithstanding any provisions of Section 6.04 10.1 or 10.2 to the contrary, if damage to or destruction of the Hotel Leased Property occurs during the last twelve twenty-four (1224) months of the then Term (including any exercised Renewal Extended Term) and if such damage or destruction cannot reasonably be expected to be fully repaired and restored prior to the date that is nine twelve (912) months prior to the end of the such Term (including any exercised Renewal Extended Term), the provisions of Section 6.04.A 10.2.1 shall apply as if the Hotel Leased Property had been totally or partially destroyed and the Hotel rendered Unsuitable for Its its Permitted Use.

Notwithstanding any provisions of Section 6.04 SECTIONS 10.1 or 10.2 to the contrary, if damage to or destruction of the Hotel Property occurs during the last twelve two (122) months - 49 - years of the Term (including any exercised Renewal Termautomatic Extended Terms) and if such damage or destruction cannot reasonably be expected to be fully repaired and restored prior to the date that is nine twelve (912) months prior to the end of the Term (including any exercised Renewal Term), the provisions of Section 6.04.A SECTION 10.2.1 shall apply as if the Hotel such Property had been totally or partially destroyed and the Hotel thereon rendered Unsuitable for Its Permitted Use.

Damage Near End of Term. 60- Notwithstanding any provisions of Section 6.04 10.1 or 10.2 to the contrary, if damage to or destruction of the Hotel Leased Property occurs during the last twelve (12) months of the then Term (including any exercised Renewal Extended Term) and if such damage or destruction cannot reasonably be expected to be fully repaired and restored prior to the date that is nine (9) months prior to the end of the such Term (including any exercised Renewal Extended Term), the provisions of Section 6.04.A 10.2.1 shall apply as if the Hotel Leased Property had been totally or partially destroyed and the Hotel rendered Unsuitable for Its its Permitted Use.
