If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. Our sole responsibility for an error in a transfer will be to correct the error. However, there are some exceptions. We will not be liable for instance: • If, through no fault of ours, you do not have adequate funds in your account to complete a transaction, your account is closed, or the transaction amount would exceed your credit limit on your line of credit, if applicable. • If you used the wrong access code, used an access code or Debit Card in an incorrect manner, or you have not properly followed any applicable computer, or Credit Union user instructions for making transfer and xxxx payment transactions. • If the Debit Card has expired or is damaged and cannot be used. • If the automated teller machine (ATM) where you are making the transfer does not have enough cash or was not working properly and you knew about the problem when you started the transaction. • If circumstances beyond our control (such as fire, flood, telecommunication outages, postal strikes, equipment or power failure) prevent making the transaction. • If the funds in your account are subject to an administrative hold, legal process or other claim. • If you have not given the Credit Union complete, correct and current instructions so the Credit Union can process a transfer. • If the error was caused by a system of any participating ATM network, or a system beyond the Credit Union’s control such as a telecommunications system, an Internet service provider, any computer virus or problems related to software not provided by the Credit Union. • If your computer fails or malfunctions or the phone lines or Credit Union computer system was not properly working and such problem should have been apparent when you attempted such transaction. • If, through no fault of ours, a xxxx payment or funds transfer transaction does not reach a particular payee due to changes in the payee address, account number or otherwise; the time you allow for payment delivery was inaccurate; or the payee failed to process a payment correctly, or in a timely manner, and a fee, penalty, or interest is assessed against you. • There are other exceptions as established by the Credit Union from time to time.

ILLEGAL TRANSACTIONS PROHIBITED You agree that you will not use your accounts, card or any of our electronic services for any trans- action that is illegal under applicable federal, state or local law. VISA FOREIGN TRANSACTIONS Purchases and cash withdrawals made in foreign countries and foreign currencies will be debited from your account in the operating regulations established by VISA International. Currently the currency conversion rate used to determine the transaction amount in U.S. dollars is generally either a government-mandated rate, or the wholesale rate, in effect the day before the transac- tion processing date, increased by one percentage point. The currency conversion rate used on the processing date may differ from the rate that would have been used on the purchase date or cardholder statement posting date. STOP PAYMENT RIGHTS: If you have arranged in advance to make regular EFTs out of your account(s) for money you owe others, you may stop payment of preauthorized transfers from your account. You must notify us orally or in writing at any time up to time(3) business days before the scheduled date of the transfer. We may require written confirmation of the stop payment order to be made within fourteen (14) days of oral notification. If we do not receive the written confirma- tion, the oral stop payment order shall cease to be binding fourteen (14) days after it is made.

The Credit Union reserves the right, without liability, to reject or reverse a Bill Payment if you fail to comply with this requirement or any other terms of this agreement. If you do not have sufficient funds in the Account and the Credit Union has not exercised its right to reverse or reject a Bill Payment, you agree to pay for such payment obligations on demand. You further agree the Credit Union, at its option, may charge any of your accounts with the Credit Union to cover such payment obligations.
