Common use of Corrective Action and Notice Clause in Contracts

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.1 (Use Restrictions), Customer shall, shall and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Hosting Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized accessCribMaster Materials); and (b) notify PTV CribMaster of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3, Customer shall, and shall cause its Authorized Users to, immediately: : (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Provider of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV HP Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) immediately notify PTV HP of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials Solutions and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV CentralSquare of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3clause 3.3 or 6.1, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials Service and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Supplier of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized accessServices); and (b) notify PTV Hudl of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.2, Customer shall, and shall cause its Authorized Users to, immediatelypromptly: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access)effects; and (b) notify PTV Word-Tech of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.32.3, Customer shall, and shall cause its Authorized Users to, immediately: : (a) take all reasonable and lawful hereto measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services DATAMARK SaaS and PTV Related Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV DATAMARK of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.34.2, Customer shall, and shall cause its Authorized Users to, immediately: (a1) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services Software, Documentation, and PTV Materials NKA materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b2) notify PTV NKA of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section clause 3.3, Customer shall, and shall cause its Authorized Authorised Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized unauthorised access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized accessServices); and (b) notify PTV of any such actual or threatened activity.and

If Customer becomes aware of any actual or threatened activity prohibited by Section clause 3.3, Customer shall, and shall cause its Authorized Authorised Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized unauthorised access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized accessServices); and (b) notify PTV Hudl of any such actual or threatened activity.

Corrective Action and Notice. If Customer and End User becomes aware of any actual or threatened activity prohibited by Section 3.33.1, Customer and End User shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services Service and PTV Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) immediately notify PTV Provider of any such actual or threatened activity.activity.‌

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.32.3, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful hereto measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services DATAMARK SaaS and PTV Related Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV DATAMARK of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.1, Customer shall, and shall cause its Authorized Authorized‌ Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Provider of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.1, Customer shall, and shall cause its Authorized Users to, immediately: : (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Provider of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.2, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Provider of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.4, Customer shall, and shall cause its Authorized Customer Users toor End Users, as the case may be, to immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV HEALTHeNET Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV HEALTHeNET of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.32.01, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Provider of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened acts or activity prohibited by Section 3.3this Section, Customer shall, and shall cause its Authorized Users to, immediately: (ai) take all reasonable and lawful measures within their respective control that are necessary helpful to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Macorva Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (bii) notify PTV Macorva of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.1, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV Viasat of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33, Customer shall, and shall cause its Customer’s Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV 5thPort Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV 5thPort of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV LI-COR Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV LI-COR of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.1, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV RigNet Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV RigNet of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.33.1, Customer shall, and shall cause its Authorized Users to, immediatelypromptly: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV LTSE Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify PTV LTSE of any such actual or threatened activity.

Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by in violation of Section 3.2 or Section 3.3, Customer shall, and shall cause its Authorized Users to, all Persons immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and PTV Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); Unqork Materials) and (b) notify PTV Unqork of any such actual or threatened activity.

Corrective Action and Notice. If Customer Client becomes aware of any actual or threatened activity prohibited by Section 3.33.B, Customer Client shall, and shall cause its Authorized Users to, immediately: (ai) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services Services, Professional Services, and PTV Clearsense Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (bii) notify PTV Clearsense of any such actual or threatened activity.
