Corrective Action and Notice. If Customer becomes aware of any actual or threatened activity prohibited by Section 3.3, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Services and Provider Materials and permanently erasing from their systems and destroying any data to which any of them have gained unauthorized access); and (b) notify Provider of any such actual or threatened activity.

If Customer becomes aware of any actual or threatened activity prohibited by Section 6, Customer shall, and shall cause its Authorized Users to, immediately: (a) take all reasonable and lawful measures within their respective control that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorized access to the Solutions and permanently erasing from their systems and destroying any data to which any of them gained unauthorized access); and (b) notify CentralSquare of any such actual or threatened activity.

If Client becomes aware of any actual or threatened activity outside the Permitted Uses or that are prohibited by Sections 6.3 or 6.4 hereof, Client shall, and shall cause its Authorized Users to, immediately: (i) take all reasonable and lawful measures within its control that are necessary to stop the activity or threatened activity and to mitigate its effects; and (ii) notify lnvictus of any such actual or threatened activity.

If a party or its Authorized Users become aware of any actual or threatened breach of this Section 6 (a “Breach”), that party will: (a) notify the other parties of the Breach and assist the Operator with its investigation of the Breach; and (b) take all reasonable and lawful measures within its control (at its own expense) that are necessary to stop the Breach or mitigate its effects.

If Broker becomes aware of any actual or threatened activity prohibited by this Section 3, then Broker shall, immediately: (a) take all reasonable and lawful measures within its control necessary to stop the activity or threatened activity and to mitigate its effects; and (b) notify HWML of any such actual or threatened activity.
