CORE WORKERS. Section 1. The parties agree that non-signatory contractors of any tier often have employees on their payroll that have worked for the contractor for an extended period of time. These workers, referred to as core workers, are believed to contribute to the efficiency and competitiveness of such non-signatory contractors. SPS seeks to remove barriers for non-signatory Contractors so they can compete effectively on projects covered by the SCWA without unnecessarily displacing all their own workers to do so, provided that such workers performing covered employment shall be compensated as specified in ARTICLE III (Payday, Wage Rates and Fringe Benefits) and observe the working conditions specified in ARTICLE II (Project Conditions) and ARTICLE IV (Hours of Work, Overtime, Shift and Work Rules). A contractor of any tier that is not signatory with any Union party to this Agreement may request as many as three core workers and up to two apprentices (as defined below) for each contract that they perform for the Project. The ratio of apprentices to journey level workers must remain in compliance with the applicable apprenticeship program standards. The Contractor shall inform the Union that is applicable to the scope of work that the proposed Core Worker will perform and provide the name and scope of work that such a core worker would perform. Section 2. Upon request of SPS or any Union, Contractors must demonstrate that the core worker meets the applicable requirements for a journey-level placement or for an apprentice placement. The Contractor shall provide detailed documentation at the pre- job conference identifying their Core Workers for the project and the core worker’s scope of work and certified payroll data to verify that the worker meets the required definition, redacted as appropriate. A Journey level Core Worker must have: 1. worked on the Contractor' payroll a minimum of one thousand five hundred (1500) hours within the craft classification over the last two-year period (given the date of dispatch to the Covered Project); and 2. been on the Contractors active payroll for at least sixty (60) out of the ninety (90) calendar days prior to the execution of the cover project contract for the affected Contractor; and 3. all the appropriate minimum requirements and qualifications, including either journey level qualifications of the craft they are performing or Apprenticeship placement, and shall hold all required licenses and certifications for the work of their craft. Apprentices that are proposed as Core Workers shall be enrolled in a WSATC program and must be an SPS Priority Hire (see DEFINITIONS). Section 3. SPS shall monitor Contractor compliance to this Core Worker definition. Section 4. No Core worker covered by this SCWA shall be required to join any Union as a condition of being employed on the project.

SPS seeks to remove barriers for non-signatory Contractors so they can compete effectively on projects covered by the SCWA without unnecessarily displacing all their own workers to do so, proof provided that such workers performing covered employment shall be compensated as specified in ARTICLE III (Payday, Wage Rates and Fringe Benefits) and observe the working conditions specified in ARTICLE II (Project Conditions) and ARTICLE IV (Hours of Work, Overtime, Shift and Work Rules). 2. been on the Contractors /Employer's active payroll for at least sixty the last ninety (6090) out of the ninety one hundred and twenty (90120) calendar working days prior to the execution award of the cover project contract a Construction Contract;
(b) Possession of all licenses and certifications required by applicable state and federal law for the affected ContractorProject Work; and
3. all (c) Has worked at least two thousand (2,000) hours in the appropriate minimum construction craft during the past two years.
8.5.1 The following procedure shall apply for dispatch of Core Workers: The first one (1) worker will be referred from the applicable Union hiring hall out-of-work list, then one (1) Core Worker shall be selected and referred from the hiring hall, followed by one (1) worker from the hiring hall out-of-work list, and this process shall repeat until such Contractor/Employer's requirements are met or until such Contractor/Employer has hired five (5) such Core Workers for that trade or craft, whichever occurs first. Thereafter, all additional employees in the affected trade or craft shall be hired exclusively from the applicable hiring hall out-of-work list. In the event the Contractor/Employer reduces the workforce, such reduction will take place in the reverse order starting with a Core Worker and qualificationsin the same ratios as was applied in hiring. In addition, including either journey level qualifications at the request of the craft they are performing Building Trades Council or Apprenticeship placementUnion, Contractor/Employer shall submit a Core Worker list to the requesting party and shall provide payroll records evidencing the worker's qualifications as a Core Worker.
8.5.2 This provision applies only to employers not currently working under a current Master Agreement and is not intended to limit the transfer provisions of the Master Agreement of any trade. As part of this process, and in order to facilitate the contract administration procedures and appropriate fringe benefit fund coverage, all Contractor(s)/Employer(s) shall hold all required licenses and certifications for the work of require their craft. Apprentices that are proposed as Core Workers shall be enrolled in a WSATC program to register with the appropriate Union hiring hall prior to the first day of employment on the Project and must be an SPS Priority Hire (see DEFINITIONS)to comply with Union security on or before the eighth [8th] day of consecutive or cumulative employment on the Project.
Section 38.5.3 Prior to each Contractor performing any Project Work, such Contractor or subcontractor shall provide a list of its Core Workers to the City and the Building Trades Council. SPS shall monitor Failure of such a Contractor compliance to this do so will result in that Contractor being prohibited from using any Core Worker definitionWorkers on that Construction Contract.
Section 4. No Core worker covered by this SCWA shall be required to join any Union as a condition of being employed on the project.
