CONTRACT RATES. A. The Contract rates shall be as stated in the Appendices attached hereto. B. The SpotOn Booking service via Carrier’s website is provided free-of-charge. However, any cancellation, no-show or modification of carriage of the SpotOn Booking by Merchant is subject to applicable fees, passing-on of costs and/or reprice of freight, in accordance with the tariffs and rules set out in Carrier’s published SpotOn Booking Cancellation & Amendment Fees applicable to CMA CGM, available at ▇▇▇▇▇://▇▇▇.▇▇▇.▇▇▇.▇▇/my-anl/prices/instant-quote-spoton and all references to “Shipper” and “Consignee” therein shall be understood as references to Merchant. Said fees apply as soon as the booking is confirmed by ▇▇▇▇▇▇▇ and may depend upon the Estimated Time of Departure (“ETD”) of the vessel identified on the original SpotOn Booking. Notwithstanding the foregoing, all SpotOn U.S. export cotton shipments shall be excluded from the standard SpotOn cancellation fee. In case of equipment shortage, cancellation by Carrier, or in case of rolling of Merchant’s cargo, ▇▇▇▇▇▇▇▇’s sole remedy shall be the cancellation of the relevant SpotOn Booking free-of-charge. C. The Contract rates are not applicable for commodities excluded from FAK, including any commodities as specified in the offer and military and U. S. Government Agency Household Goods, U.S. flag impelled government and/or military cargo, U.S. government sponsored Cargo, Humanitarian Aid/Emergency Relief Cargo, and Project Cargo of the type described in CFR 520.2 (collectively US-Flag Government Impelled Cargo). D. The Contract rates are not subject to General Rate Increases (GRI).
