Contract Exemptions. 17.10.1 Notwithstanding the general provisions of this Agreement, where special circumstances exist, the Company and an Employee may agree to a package of terms and conditions, which will be provided for under the terms of a common law contract of employment which will exempt the Employee concerned from the provisions of this Agreement. The package agreed must be no less favourable in the aggregate to the Employee. In such circumstances the Employee shall continue to have the right to request employee representation in relation to grievance matters. 17.10.2 As a general rule the terms and conditions shall provide for a base rate of pay at least 5% higher than the relevant grade classification / wage rates as set out in Agreement. 17.10.3 Special circumstances may include where: • an employee(s) undertakes a function significantly different from the main workforce • an employee works predominantly alone or in an isolated location • a particular job requires an irregular pattern of hours or shifts • where it is a requirement by the customer Where special circumstances have been identified, the Workplace Agreement Consultative Committee shall be advised of the intent to negotiate a contract exemption. Any concerns identified by the Workplace Agreement Consultative Committee shall be progressed in accordance with the Settlement of Disputes provisions. 17.10.4 An Employee may withdraw from an exempt common law contract of employment by the giving of one month's notice and upon so doing shall revert to a contract of employment based upon the classification and terms and conditions prescribed by this Agreement.
