Common use of CONTINUOUS PERFORMANCE PLEDGE Clause in Contracts

CONTINUOUS PERFORMANCE PLEDGE. The Union agrees that it will neither cause nor sponsor any strike, slow-down, or other work stoppage during the term of this Agreement. In the event that the Union violates this provision, it shall be subject to appropriate penalties by the Board, provided that any disputes pertaining to employee discipline shall be subject to the grievance procedure. In recognition of this continuous performance pledge, the Board agrees there will be no "lock-out" of members of the Union except if such "lock-out" is a result of the Board's inability to pay which results in the closing of all schools. Any dispute as to whether this provision has been violated shall be subject to the grievance procedure. Any employee who initiated or participates in a strike or other act prohibited by this Article will be subject to disciplinary action by the Board; provided, however, that the question of such participation shall be subject to the grievance procedure set forth in Article 7. The Union will make every reasonable effort to prevent or terminate violations of this Article.
