Common use of Contingency of Funding Clause in Contracts

Contingency of Funding. 6.45.1 XXXX acknowledges that funding or portions of funding for this Contract may also be contingent upon receipt of funds from, and/or appropriation of funds by, the State of California or other funding sources to Owner. If such funding and/or appropriations are not forthcoming, or otherwise limited, Owner may immediately terminate or modify this Contract without penalty.
