Lack of Funding. The Parties recognize that the compensation provided for in this Grant Contract depends on budget approval and appropriations of sufficient grant funds by the Lancaster County Board of County Commissioners (“Grant Funds”). The Parties further recognize that the Sponsor may terminate this Grant Contract in whole or in part immediately upon written notice to Grantee if grant funds do not receive sufficient budget approval or appropriations. The date Project Monitor sends the written notice of termination shall be the date of termination. The Grantee understands and agrees that the Sponsor shall not provide for funding under this Grant Contract from the Lancaster County General Fund, tax revenue, or any other source, and that the sole source of funding for this Grant Contract shall be approved and appropriated Grant Funds. In the event that Grant Funds do not receive sufficient budget approval or appropriations, the Grantee shall be compensated pursuant to the terms of this Grant Contract for authorized Project Account costs charged against the Project Account prior to the date of termination according to the approved Project Budget. Xxxxxxx agrees that Xxxxxxx has no reasonable expectation of payment for unauthorized costs, or for payment of any kind from any other source. The Grantee further understands and agrees that any costs not covered by the current Grant Contract are not authorized.

Lack of Funding. The License Agreement may be canceled without further obligation on the part of the Arizona Board of Regents and the University of Arizona in the event that sufficient appropriated funding is unavailable to assure full performance of the terms. The party to this License Agreement shall be notified in writing of such non-appropriation as soon as reasonably possible. No penalty shall accrue to the Board or the University in the event this cancellation provision is exercised. This cancellation provision shall not be construed so as to permit the University to terminate the License Agreement in order to offer similar services to another party.

The Parties further recognize that the Sponsor may terminate this Subaward Contract in whole or in part immediately upon written notice to Subrecipient if Outside Grant’s funds run out or are no longer available. The date Project Monitor sends the written notice of termination shall be the date of termination. The Subrecipient understands and agrees that the Sponsor shall not provide for funding under this Subaward Contract from the Lancaster County General Fund, tax revenue, or any other source, and that the sole source of funding for this Subaward Contract is the aforementioned Outside Grant. In the event that Subaward funds under the Outside Grant are no longer available or run out, the Subrecipient shall be compensated pursuant to the terms of this Subaward Contract for authorized Project Account costs charged against the Project Account prior to the date of termination according to the approved Project Budget. Subrecipient agrees that Subrecipient has no reasonable expectation of payment for unauthorized costs, or for payment of any kind from any other source. The Subrecipient further understands and agrees that any costs not covered by the current Subaward Contract are not authorized.
Lack of Funding. The parties recognize that the compensation provided for in this agreement is based upon funds from the State of Nebraska Commission on Law Enforcement and Criminal Justice. The parties further recognize that the County may terminate the agreement immediately if grant funds are no longer available.
