Common use of Construction Status Clause in Contracts

Construction Status. Transmission Owner shall keep Customers and Transmission Provider advised periodically as to the progress of its respective design, procurement and construction efforts as described in Appendix A. A Customer may, at any time, request a progress report from Transmission Owner, with a copy to be provided to all other Parties. If, at any time, a Customer determines that the completion of the Shared Network Upgrade will not be required until after the specified In-Service Date, such Customer will provide written notice to all other Parties of such later date for the completion of the Shared Network Upgrade. Transmission Owner may delay the In- Service Date of the Shared Network Upgrade accordingly, but only if agreed to by all other Customers.
