Common use of Construction Status Clause in Contracts

Construction Status. Transmission Owner shall keep Customer and Transmission Provider advised periodically as to the progress of its respective design, procurement and construction efforts as described in Appendix A. Customer may, at any time, request a progress report from Transmission Owner, with a copy to be provided to Transmission Provider. If, at any time, Customer determines that the completion of the Network Upgrades and System Protection Facilities will not be required until after the specified In-Service Date, Customer will provide written notice to Transmission Owner and Transmission Provider of such later date upon which the completion of the Network Upgrades and System Protection Facilities would be required. Transmission Owner may delay the In-Service Date of the Network Upgrades accordingly.
