Common use of Construction Observation Clause in Contracts

Construction Observation. A) The purpose of Xxxx Engineering's presence at the site(s) is to enable Xxxx to provide for Client a greater degree of assurance that the completed work of contractor(s) do in fact generally conform to the contract documents. On the other hand, it is understood that, during such visits or as a result of such field observations, monitoring, and/or testing of contractor(s)' work-in-progress, Xxxx will not have authority to supervise, direct, or control contractor(s)' work. Xxxx is there only to report to Client what Xxxx believes is compliance or non-compliance with the contract documents. Thus, it is agreed that Xxxx Engineering shall have no responsibility for the means, methods, techniques, sequences, or procedures selected by the contractor(s), for the safety precautions and programs chosen by the contractor(s) or for any failure of the contractor(s) to comply with any laws applicable to the work being performed by the contractor(s).
