Construction Documents Phase. 3.5.1 Based on the approved Design Development Documents and any further adjustments in the scope or quality of the Project or in the construction budget authorized by Owner, Architect/Engineer shall prepare, for written approval by Owner, “Construction Documents” consisting of drawings and specifications setting forth in detail the requirements for the construction of the Project. Architect/Engineer shall submit a minimum of seven (7) half-size sets and one (1) full-size set of documents, including one (1) set of AutoCAD electronic files and one (1) set of BIM files, as required by BIM Standards, to Owner for review and approval at 50% completion and then again at 100% completion, together, each time, with an estimate of Construction Cost. Architect/Engineer shall submit a minimum of four (4) full size sets of 100% Construction Documents (signed and sealed), after they have been reviewed and approved by Owner in writing, together with an estimate of Construction Cost. 2.3.5.4 The Owner shall cause the Construction Manager to furnish to the Owner and the Professional a complete list of the assumptions utilized by the Construction Manager in the development of the initial Guaranteed Maximum Price proposal and the finally agreed Guaranteed Maximum Price with respect to (a) changes in the initial set of Construction Documents on which the proposed or agreed Guaranteed Maximum Price is based, and/or (b) Project components not fully described in such Construction Documents. The Professional shall review and analyze such assumptions, and shall submit a written analysis of each of them to the documents to Owner, pointing out any inaccuracies listed that, in the respective GMPsProfessional’s opinion, are inaccurate, inconsistent with the design intent of the Project or not in accordance with the generally accepted standards of professional practice. Upon resolution by the Owner, Construction Manager and Professional of the issues raised in such written analysis, the Professional shall complete or modify the Construction Documents as needed.
3.5.2 Architect/Engineer shall furnish to Owner one (1) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, as required by BIM Standards.
3.5.3 2.3.5.5 After the Guaranteed Maximum Price has been acceptedaccepted by the Owner, Architect/Engineer the Professional shall incorporate into the Construction Documents any revisions which are necessary due to clarify and explain inaccurate assumptions made in the scope development of work included in the Guaranteed Maximum Price.

2.4.3 The A/E, to Owner for review and approval at 50%, 75% completion and then again at 100& 95% completion, together, each time, with an estimate of Construction Cost. Architect/Engineer shall submit a minimum of four (4) full size furnish and deliver to the Owner’s Representative complete sets of 100% Construction Documents (signed all plans, drawings and sealed)specifications in connection with the Work for review. The A/E shall incorporate into the plans, after they have been reviewed drawings and approved by specifications such changes as are necessary to satisfy the Owner’s review comments, any of which may be appealed in writing for good cause.
2.4.4 The A/E shall assist the Owner in writing, together connection with an estimate the Owner’s responsibility and procedures for obtaining approval of Construction Cost. Prior to Construction Manager’s written notice to proceed, Architect/Engineer must submit an Architect/Engineer affidavit to all authorities having jurisdiction over the FIU Department of Building Code Administration to be able to issue the permit to Construction Manager.

2.4.5 The reproduction of all plans, specifications and other documents for use by the A/E and its consultants and all documents reproduced for the various completion stage reviews by the Owner prior to the reproduction of bidding or proposal documents shall be paid for by A/E, without sales tax, out of the allowance for Reimbursable Expenses set forth in the Project Addendum. Addenda documents issued after the bid documents are reproduced shall be supplied as a reimbursable expense.
2.4.6 The A/E shall direct the preparation of an updated detailed Construction Cost Estimate as described in Sub-paragraph 2.1.8.1 to confirm adherence to the Construction Cost Limitation and present the same with the completed Construction Documents.
2.4.7 During the development of the Construction Documents, the A/E shall assist the Owner in the development and preparation of (1) bidding and procurement information that describes the time, place, and conditions of bidding, including bidding or proposal forms; (2) the form of agreement between the Owner and Contractor; and

Construction Documents Phase. 3.5.1 Based on 4.1 The A/E must receive written notice from the approved Design Development MPTN Project Manager to proceed with the Construction Documents and any further adjustments Phase before commencing the said phase. The documents to be provided in the scope or quality this phase are a part of the Project or in the construction budget authorized by Ownercontract and, Architect/Engineer as such, shall prepare, for written approval by Owner, “Construction Documents” consisting consist of complete and fully coordinated construction drawings and specifications setting forth in detail the requirements for the construction of the Project (the “Construction Drawings”).
4.2 The A/E shall provide a detailed code analysis on the cover sheet of the Construction Drawings, in a format acceptable to the MPTN Land Use Department. The analysis shall include at a minimum; the building type, use/occupancy group, construction type, applicable codes and any relevant information about maximum occupancy, travel distances, egress paths and fixture counts. The cover sheet shall also include a list of all the project drawings, a list of the design professionals working on the Project, and a location key plan.
4.3 The A/E shall ensure that the drawings of all the architectural and engineering disciplines are coordinated to express the complete and accurate scope of the work, and to eliminate conflicts between the various disciplines.
4.4 The A/E shall include MPGE “owner specified equipment” in the Construction Drawings and be responsible for coordinating the equipment and wiring with the rest of the Project.
4.5 The A/E will meet with the MPTN Land Use Department (and other MPTN authorities having jurisdiction) as required to review additional code issues that arise as the documents are developed, and if necessary, amend the plans accordingly without additional cost to MPTN.
4.6 During the Construction Documents Phase, the A/E shall review and revise its cost estimate periodically and advise MPTN if scope modifications or reductions are necessary to bring the Project back in line with the Project Budget and Schedule.
4.7 All Construction Drawings shall conform to the MPTN Record Drawing Standards. ArchitectAll specifications shall conform to CSI standards. Review and approval by the MPTN of the Construction Documents does not relieve the A/Engineer E of any responsibility arising out of the MPTN’s reliance on the A/E’s professional skill and ability to discharge the services required by this Agreement.
4.8 At the completion of the Construction Documents Phase, the A/E shall submit a minimum of seven (7) half-size sets and one one
(1) full-size unstamped set of documentsthe final construction drawings and specifications to the MPTN Land Use Department for review. Upon completion of review by the MPTN Land Use Department, including one (1) set of AutoCAD electronic files the A/E shall, at no further cost to MPTN, incorporate all required changes to the said drawings and one (1) set of BIM files, as required by BIM Standards, to Owner for review and approval at 50% completion and specifications. The A/E shall then again at 100% completion, together, each time, with an estimate of Construction Cost. Architect/Engineer shall submit a minimum of provide four (4) full size stamped sets of 100% Construction Documents (signed and sealed), after they have been reviewed and approved by Owner in writing, together with an estimate of Construction Cost. Prior to Construction Manager’s written notice to proceed, Architect/Engineer must submit an Architect/Engineer affidavit the completed construction documents to the FIU Department MPTN Land Use Commission for approval of Building Code Administration to be able to issue the permit to Construction Manager.
3.5.1.1 At the completion of 100% Construction Documents, Construction Manager will prepare a Guaranteed Maximum Price (hereinafter referred to as the “Guaranteed Maximum Price” or “GMP”) proposal based on the 100% Construction Documents prepared by Architect/Engineerbuilding permit. The ArchitectA/Engineer E shall resolve with Owner any discrepancy between the estimates of Construction Cost and the scope and requirements of Owner. Architect/Engineer shall assist Owner in its negotiations with Construction Manager in an effort provide up to develop an acceptable Guaranteed Maximum Price. If Owner does not accept Construction Manager's Guaranteed Maximum Price proposal, Architect/Engineer shall cooperate in value engineering with Owner and Construction Manager to revise the Construction Documents as necessary in order to reach an agreement. Architect/Engineer shall analyze each ten (10) unstamped sets (per directive of the final Guaranteed Maximum Price MPTN Project Manager) for use by the MPTN Projects Department. In addition, the A/E shall provide two (2) CD-ROM’s containing the Project Drawings and Project Manual that comprise the construction documents, and shall submit a written analysis of each of the documents to Owner, pointing out any inaccuracies listed in the respective GMPs.
3.5.2 Architect/Engineer shall furnish to Owner one (1) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, . The CD-ROM drawings as required by BIM this sub-paragraph shall be in an AutoCAD version, and in a format as required by the MPTN Record Drawing Standards. The MPTN project number and name is to be listed on each drawing title block, the cover of the Project Manual, and each individual page of the documents.
3.5.3 After 4.9 The A/E shall provide to the Guaranteed Maximum Price has been acceptedMPTN, Architectfor all projects located outside of the boundaries of the MPTN Reservation, a “Certificate of Substantial Compliance with the Connecticut Building and Fire Safety Codes” bearing original signatures and seals, stating: “This is to certify that the design of the referenced structure is in compliance with the Connecticut Building and Fire Safety Codes adopted by the State of Connecticut, including the following approved modifications of code (list if any).” In the event that the Project is to be constructed on the MPTN Reservation the Certificate shall state: “This is to certify that the design of the referenced structure is in compliance with the MPTN Land Use Commission requirements.” The A/Engineer E shall incorporate into provide the Certificate to the MPTN’s Project Manager when the completed Construction Documents any revisions which documents are necessary submitted to clarify and explain the scope of work included in the Guaranteed Maximum PriceMPTN Land Use Commission for approval.
3.5.4 Architect/Engineer shall assist Owner in connection with Owner's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.

Construction Documents Phase. 3.5.1 Based on the previously approved Design Development Documents documents and any further adjustments in the scope or quality of the each Project or in the construction budget authorized by the Owner, the Architect/Engineer shall prepare, for written approval by the Owner, “Construction Documents” Documents consisting of drawings Drawings and specifications Specifications setting forth in detail the requirements for the construction of the each Project. 3.5.3 After the Guaranteed Maximum each Construction Price has been accepted, the Architect/Engineer shall incorporate into the Construction Documents any revisions which are necessary to clarify and explain the scope of work included in the Guaranteed Maximum each Construction Price.
3.5.4 The Architect/Engineer shall assist the Owner in connection with the Owner's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the each Project.

Construction Documents Phase. 3.5.1 Based 4.1 The A/E must receive written notice from the MPTN Project Manager to proceed with the Construction Documents Phase before commencing the said phase. The documents to be provided in this phase are a part of the construction contract and,
4.2 The A/E shall provide a detailed code analysis on the approved Design Development Documents cover sheet of the Construction Drawings, in a format acceptable to the MPTN Land Use Department. The analysis shall include at a minimum; the building type, use/occupancy group, construction type, applicable codes and any further adjustments relevant information about maximum occupancy, travel distances, egress paths, and fixture counts. The cover sheet shall also include a list of all the project drawings, a list of the design professionals working on the Project, and a location key plan.
4.3 The A/E shall ensure that the drawings of all the architectural and engineering disciplines are coordinated to express the complete and accurate scope of the

4.7 All Construction Drawings shall prepare, for written conform to the MPTN Record Drawing Standards. All specifications shall conform to CSI standards. Review and approval by Ownerthe MPTN of the Construction Documents does not relieve the A/E of any responsibility arising out of the MPTN’s reliance on the A/E’s professional skill and ability to discharge the services required by this Agreement.
4.8 At the completion of the Construction Documents Phase, “Construction Documents” consisting the A/E shall submit one

Construction Documents Phase. 3.5.1 Based 1. Upon written authorization to proceed from Owner, Architect shall prepare, based upon the approved Design Development Documents, Construction Documents consisting of Drawings, Specifications and other documents setting forth in detail the scope of the Project. Such documents shall describe materials, standards of workmanship, finishes, equipment and the conditions affecting the Work required to be performed in all divisions of the construction work and comply with the requirements of Attachment B, Document Requirements. A checklist based on Attachment B shall be submitted with the Construction Document review sets noting any exceptions or omissions to the requirements of Attachment B, for Owner's approval.
2. Architect, in preparation of this phase of the Work, shall follow the scope and form of the Project as set forth in the approved Design Development Documents except that Architect shall incorporate changes requested in writing by Owner.
3. In preparing the Construction Documents, Architect shall, in consultation with Owner, prepare the necessary bidding information, bidding forms, and any further adjustments the form of Agreement between Owner and Contractor (the "Construction Contract"), which shall include Owner's General Conditions of the Contract, with Amendments, Special Conditions, and standard forms, as furnished by Owner and ensure that the subsequent divisions of the Construction Documents are consistent therewith.
4. Architect shall conduct a detailed intra- and interdisciplinary document check in accordance with the Quality Assurance requirements set forth in Article XII of this Agreement. This document check and the resulting corrections must be completed prior to printing of the Construction Documents for Owner's review. Architect shall submit to Owner documentation confirming that the document check has been comp leted.
5. a) Architect shall continue to maintain the cost estimate in the scope or quality cost model submitted to the Owner at the end of Design Development Phase. The “Established Target Value Model” column will not be changed during this phase. The “Design Tracking Model” column will be continually updated throughout this phase. As the Project or Construction Documents are developed, decisions will be made regarding cost and value. The “Design Tracking Model” column will be tracked against the “Established Target Value Model” column to ensure the Construction Documents are progressing in a manner that is consistent with the construction budget authorized by Owner, Architect/Engineer shall prepare, for written approval by Owner, “Construction Documents” consisting of drawings and specifications setting forth in detail Target Value Design goals established at the requirements for the construction beginning of the Project. 3.5.3 After the Guaranteed Maximum Price has been accepted, Architect/Engineer which Architect shall incorporate into the Construction Documents.
2. When the construction documents are complete and contain all appropriate information, Architect shall confer with and obtain permit approval from such regulatory agencies as Bureau of Buildings, City Fire ▇▇▇▇▇▇▇▇, Department of Health, Georgia Department of Education. Architect shall check with the applicable regulatory agencies and establish schedule for submission and/or review. Any disapproval from these agencies must be corrected before drawings are released for bidding.
3. Architect shall complete the following tasks:
a. Coordinate the work of all members of the team, including consultants. Coordinate drawings with project specification.
b. Determine what items, if any, are to be furnished by Owner, or are not to be included in the construction contract.
c. Obtain schedule for delivery and installation of Owner-furnished materials.
d. Check all completed documents for coordination, compliance with program, accuracy and cross-coordination with the consultants’ and engineers’ work, and have them make similar checks.
e. Revise documents if required after check and have consultants and engineers do the same.
f. Place appropriate architect and engineer’s seals on the documents and obtain any necessary signatures required by reviewing authorities.
4. Construction Documents shall be packaged as prescribed in the Management Plan and be completed in accordance with the Critical Dates Schedule. Inform Owner of any revisions which are necessary to clarify and explain the scope of revisions.
5. Detailed drawings shall cover all work included in the Guaranteed Maximum PriceProject or designated portion thereof.
3.5.4 6. Single or multiple contracts shall be as stated in the Management Plan, and the detailed drawings for each contract shall be prepared by Architect with appropriate designation noted thereon.
7. Specifications shall be prepared using the Construction Specifications Institute (CSI) format. (On “CD” Disk in fully functional Microsoft Word.
8. Architect shall provide furniture layouts as requested by Owner including but not limited to the following spaces: Science Rooms, Media Center, Cafeteria, and Administration Area.
9. Architect shall provide interior color selection for review and approval by Owner.
10. If requested, Architect shall provide Project Manager copies of in-progress Construction Documents during this phase. Additionally, and in accordance with the Management Plan, Architect, at its cost, shall submit for approval by Owners two (2) sets of preliminary Construction Documents at the stage of 95% completeness.
11. After review and approval of the 95% Construction Documents by Owner, Architect shall continue with preparation of final Construction Documents and “Bid Documents,” including final specifications for all authorized work on the Project and shall incorporate in those final documents the comments and any modifications and changes desired by Owner and any modifications required for compliance with all applicable codes, regulations, standards, the approved program, and prior written approvals and instructions of Owner. The resulting final Construction Documents submittal is to be a complete, fully coordinated, integrated package, suitable for bidding distribution, without any significant addenda or further clarification required.
12. Architect shall participate in such reviews and meetings as are necessary to ensure that the project design conforms to all applicable codes and all requirements of responsible agencies and will make any changes to the Construction Documents which are required for issuance of all permits and legal authorizations needed to construct the Project.
13. Documents prepared by Architect for final Construction Documents Phase submittal shall include the final working drawings and a written report. The report shall incorporate Architect’s CCAP estimate and breakdown, as well as the “Schedule of the Management Plan.” Architect shall prepare such estimates in the form prescribed by Owner to assure itself that the project cost is within the CCAP. Further, the report shall include a summary of programmed versus actual square footage by room or area. Architect, at his cost, shall supply five (5) complete sets of final construction drawings and specifications to Owner for final review and approval.
14. Architect shall apply for all construction permits and approvals on behalf of Owner as noted in item #2 above.
15. After receiving written authorization from Owner, Architect shall proceed with the “Construction Bid/Engineer Negotiation Phase.” There may be more than one “Construction Bid/Negotiation Phase,” depending upon Owner’s requirements.
16. Architect shall prepare such clarifications and addenda to the bidding documents as may be required. Architect will provide these to Owner for review prior to issuance to all holders of bid documents.
17. Project Manager will schedule and conduct pre-bid conferences with prospective bidders to review the Project requirements. Architect shall provide knowledgeable representatives, including representatives of its consultants, and participate in these conferences to explain and clarify Bidding Documents. Within two (2) days after the pre-bid conference, Architect shall deliver to Owner, if needed, a final Addendum.
18. Architect shall assist Owner in connection obtaining bids.
19. Architect and Project Manager shall prepare a certified bid tabulation and make a recommendation to Owner concerning the “Contract Award.”
20. Should first bidding or negotiation produce prices in excess of the approved CCAP, Architect shall participate with Project Manager in such re-bidding, re-negotiation, and re-design, at no additional expense to Owner's responsibility for filing documents required for , as may be necessary to obtain price(s) within the approval approved CCAP or price(s) acceptable to Owner. Owner will assist in re- design decisions. Owner must approve all redesign.
21. Should Architect re-design or conduct re-bidding under its responsibilities set out in the preceding paragraph, its “Construction Phase and Post Construction Phase” services shall be extended to take re-design/re-bid delays into account at no additional expense to Owner.
22. Architect shall confirm in writing to Owner of governmental authorities having jurisdiction over the Projectfollowing facts:
a. All the engineering drawings and architectural drawings have been fully coordinated.
b. All the applicable codes have been complied with.

2.4.3 The Architect shall submit a written analysis of each design the Work, and prepare the Construction Documents, so that the Construction Cost, as defined in Paragraph 5.1, does not exceed the stipulated amount for the Construction Cost established between the Owner and Architect prior to the completion of the documents Design Development Phase. This limitation is of the essence of this Agreement, subject to Owner, pointing out any inaccuracies listed in the respective GMPsprovisions herein.
3.5.2 Architect/Engineer shall furnish to Owner one (1) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, as required by BIM Standards.
3.5.3 After the Guaranteed Maximum Price has been accepted, Architect/Engineer shall incorporate into the Construction Documents any revisions which are necessary to clarify and explain the scope of work included in the Guaranteed Maximum Price.
3.5.4 Architect/Engineer 2.4.4 The Architect shall assist the Owner in connection with the Owner's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.
2.4.5 Recognizing that the Owner may, in its sole discretion, require that the Project be constructed using a “fast-track” process which may not develop in accordance with all of the procedures described in this Agreement, and in order that the Project may develop in the manner most advantageous to the Owner, it is understood and agreed that the Construction Documents may not be prepared by the Architect, or the Project be bid, as a single entity if the Owner so requires. It is also recognized and agreed that by reason of the “fast-track” process, the various phases of the Architect’s Basic Services may overlap. In these situations, the Owner and Architect agree to cooperate in making appropriate adjustments to the procedures set forth in this Agreement which are based or dependent upon commencing or completing a particular phase of the Work.
2.4.6 The Architect shall use the following formats for Drawings and Specifications which will become part of the Owner’s final record:

Any fees associated with fast- tracking Phase 1 of the Project are included in the fee schedule attached hereto.
2.6.2 The Professional shall submit a minimum its Construction Cost Estimate Reports to Owner at the same time as it submits 60% Construction Documents. Upon receipt of seven (7) half-size sets and one (1) full-size set of documents60% Construction Documents, including one (1) set of AutoCAD electronic files and one (1) set of BIM files, as required by BIM Standards, the Construction Manager shall provide its cost report to the Owner for review and comparison to the Professional’s Construction Cost Estimate Report. Upon receipt of the Owner’s approval at 50of 60% completion Construction Documents, if any, the Professional shall prepare and then again at submit 100% completion, together, each time, with an estimate of Construction Cost. Architect/Engineer Documents to the Owner and the Construction Manager and the Construction Manager shall submit a minimum of four (4) full size sets its cost report to the Owner.
2.6.3 Upon Owner’s approval of 100% Construction Documents (signed and sealed), after they have been reviewed and approved by Owner in writing, together with an estimate of Construction Cost. Prior to the Construction Manager’s written notice to proceedcost report, Architect/Engineer must submit an Architect/Engineer affidavit to the FIU Department of Building Code Administration to be able to issue the permit to Construction Manager.
3.5.1.1 At the completion of 100% Construction Documents, Construction Manager will prepare a an initial Guaranteed Maximum Price (hereinafter referred to as the “Guaranteed Maximum Price” or “GMP”) proposal based on the 100% such Construction Documents prepared by Architect/EngineerDocuments. The Architect/Engineer Professional shall resolve with the Owner any apparent discrepancy between the estimates final estimate of Construction Cost and the scope of work and requirements of the Owner. Architect/Engineer The Professional shall assist the Owner in its negotiations with the Construction Manager in an effort to develop an acceptable Guaranteed Maximum Price. If the Owner does not accept the Construction Manager's ’s Guaranteed Maximum Price proposalproposal because it exceeds Owner’s budget for the Project, Architect/Engineer the Professional shall cooperate in value engineering with Owner and Construction Manager to revise the Construction Documents as necessary in order a manner acceptable to reach an agreement. 2.6.4 The Owner shall cause the Construction Manager to furnish to the Owner and the Professional a complete list of the assumptions utilized by the Construction Manager in the development of the initial Guaranteed Maximum Price proposal and the finally agreed Guaranteed Maximum Price with respect to (a) changes in the initial set of Construction Documents on which the proposed or agreed Guaranteed Maximum Price is based, and/or (b) Project components not fully described in such Construction Documents. The Professional shall review and analyze such assumptions, and shall submit a written analysis of each of them to the documents to Owner, pointing out any inaccuracies listed that, in the respective GMPs.
3.5.2 Architect/Engineer Professional’s opinion, are inaccurate, inconsistent with the design intent of the Project or not in accordance with the generally accepted standards of professional practice. Upon resolution by the Owner, Construction Manager and Professional of the issues raised in such written analysis, the Professional shall furnish to Owner one (1) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, as required by BIM Standards.
3.5.3 After the Guaranteed Maximum Price has been accepted, Architect/Engineer shall incorporate into or modify the Construction Documents any revisions which are necessary to clarify and explain the scope of work included in the Guaranteed Maximum Priceas needed.
3.5.4 Architect/Engineer shall assist Owner in connection with Owner's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.

Construction Documents Phase. 3.5.1 Based on Following the approved Design Development Documents and any further adjustments in the scope or quality end of the Project or in Pre-Development Phase, unless this Agreement has been terminated, the Developer shall coordinate with the Authority and with the Specialists and Consultants to obtain final construction budget authorized by Owner, Architect/Engineer shall prepare, for written approval by Owner, “Construction Documents” consisting of drawings and specifications setting forth in detail the requirements for the Project (the “Final Plans and Specifications”) consistent with the Development Plans, which shall be approved by the Parties as follows: (i) as they pertain to the Entertainment Venue and the Parking Facilities, to the extent they are consistent with the Development Plans, and (ii) as they pertain to the Developer Improvements, to the extent that such plans depict a mixed-use development with the same use categories and general mix, quality and balance of uses depicted in the Master Plan and remain compliant with all applicable Approvals. During the Construction Documents Phase the Developer shall provide the following services:
(a) Providing lists of, and detailed specifications for, furnishings, fixtures, equipment, operating supplies, fixed asset supplies and the like for the Entertainment Venue that meet with the Authority’s approval;
(b) Working with the Authority and Specialists and Consultants to enhance the architectural compatibility of the various elements of the Project;
(c) Preparation of a development schedule for the Project reasonably acceptable to the Authority;
(d) Timely submission to the Authority, for its approval, of final drawings and specifications for the Project, including landscaping plans, mechanical and electrical drawings, architectural appearance, interior design schemes and specialized area plans;
(e) Finalizing agreements with the Contractors (other than the General Contractor) in the Developer’s name; which Contractors shall be paid in accordance with the Construction Addendum; and
(f) Obtaining or causing to be obtained on behalf of the Authority, all building, development, and other permits necessary to commence construction of the ProjectEntertainment Venue and Public Improvements. Architect/Engineer shall submit a minimum of seven (7) half-size sets and one (1) full-size set of documents, including one (1) set of AutoCAD electronic files and one (1) set of BIM files, as required by BIM Standards, to Owner for review and approval at 50% completion and then again at 100% completion, together, each time, with an estimate of Construction Cost. Architect/Engineer shall submit a minimum of four (4) full size sets of 100% The Construction Documents (signed and sealed), after they Phase shall have been reviewed completed when all requirements in Section 5.2.2 have been satisfied, the Final Plans and Specifications for the Project have been finally approved by Owner the Developer and the Authority and contracts for the Project (other than the two or more guaranteed maximum price contracts with the General Contractor, which will be entered into in writingthe Pre-Development Phase) have been approved by the Authority and are ready for execution by the Developer. After mutual approval of the Final Plans and Specifications, together no changes may be made thereto with an estimate of Construction Cost. Prior to Construction Manager’s written notice to proceed, Architect/Engineer must submit an Architect/Engineer affidavit respect to the FIU Department of Building Code Administration to be able to issue components included within the permit to Construction Manager.
3.5.1.1 At Master Plan (as modified by the completion of 100% Construction Documents, Construction Manager will prepare a Guaranteed Maximum Price (hereinafter referred to as the “Guaranteed Maximum Price” or “GMP”) proposal based on the 100% Construction Documents prepared by Architect/Engineer. The Architect/Engineer shall resolve with Owner any discrepancy between the estimates of Construction Cost and the scope and requirements of Owner. Architect/Engineer shall assist Owner in its negotiations with Construction Manager in an effort to develop an acceptable Guaranteed Maximum Price. If Owner does not accept Construction Manager's Guaranteed Maximum Price proposal, Architect/Engineer shall cooperate in value engineering with Owner and Construction Manager to revise the Construction Documents as necessary in order to reach an agreement. Construction Documents Phase. 3.5.1 Based on 4.1 The A/E must receive written notice from the approved Design Development MPTN Project Manager to proceed with the Construction Documents and any further adjustments Phase before commencing the said phase. The documents to be provided in the scope or quality this phase are a part of the Project or in the construction budget authorized by Ownercontract and, Architect/Engineer as such, shall prepare, for written approval by Owner, “Construction Documents” consisting consist of complete and fully coordinated construction drawings and specifications setting forth in detail the requirements for the construction of the Project (the “Construction Drawings”).
4.2 The A/E shall provide a detailed code analysis on the cover sheet of the Construction Drawings, in a format acceptable to the MPTN Land Use Department. The analysis shall include at a minimum; the building type, use/occupancy group, construction type, applicable codes and any relevant information about maximum occupancy, travel distances, egress paths, and fixture counts. The cover sheet shall also include a list of all the project drawings, a list of the design professionals working on the Project, and a location key plan.
4.3 The A/E shall ensure that the drawings of all the architectural and engineering disciplines are coordinated to express the complete and accurate scope of the work, and to eliminate conflicts between the various disciplines.
4.4 The A/E shall include MPGE “owner specified equipment” in the Construction Drawings and be responsible for coordinating the equipment and wiring with the rest of the Project.
4.5 The A/E will meet with the MPTN Land Use Department (and other MPTN authorities having jurisdiction) as required to review additional code issues that arise as the documents are developed, and if necessary, amend the plans accordingly without additional cost to MPTN.
4.6 During the Construction Documents Phase, the A/E shall review and revise its cost estimate periodically and advise MPTN if scope modifications or reductions are necessary to bring the Project back in line with the Project Budget and Schedule.
4.7 All Construction Drawings shall conform to the MPTN Record Drawing Standards. ArchitectAll specifications shall conform to CSI standards. Review and approval by the MPTN of the Construction Documents does not relieve the A/Engineer E of any responsibility arising out of the MPTN’s reliance on the A/E’s professional skill and ability to discharge the services required by this Agreement.
4.8 At the completion of the Construction Documents Phase, the A/E shall submit a minimum of seven (7) half-size sets and one one
(1) full-size unstamped set of documentsthe final construction drawings and specifications to the MPTN Land Use Department for review. Upon completion of review by the MPTN Land Use Department, including one (1) set of AutoCAD electronic files the A/E shall, at no further cost to MPTN, incorporate all required changes to the said drawings and one (1) set of BIM files, as required by BIM Standards, to Owner for review and approval at 50% completion and specifications. The A/E shall then again at 100% completion, together, each time, with an estimate of Construction Cost. Architect/Engineer shall submit a minimum of provide four (4) full size stamped sets of 100% Construction Documents (signed and sealed), after they have been reviewed and approved by Owner in writing, together with an estimate of Construction Cost. Prior to Construction Manager’s written notice to proceed, Architect/Engineer must submit an Architect/Engineer affidavit the completed construction documents to the FIU Department MPTN Land Use Commission for approval of Building Code Administration to be able to issue the permit to Construction Manager.
3.5.1.1 At the completion of 100% Construction Documents, Construction Manager will prepare a Guaranteed Maximum Price (hereinafter referred to as the “Guaranteed Maximum Price” or “GMP”) proposal based on the 100% Construction Documents prepared by Architect/Engineerbuilding permit. The ArchitectA/Engineer E shall resolve with Owner any discrepancy between the estimates of Construction Cost and the scope and requirements of Owner. Architect/Engineer shall assist Owner in its negotiations with Construction Manager in an effort provide up to develop an acceptable Guaranteed Maximum Price. If Owner does not accept Construction Manager's Guaranteed Maximum Price proposal, Architect/Engineer shall cooperate in value engineering with Owner and Construction Manager to revise the Construction Documents as necessary in order to reach an agreement. Architect/Engineer shall analyze each ten (10) unstamped sets (per directive of the final Guaranteed Maximum Price MPTN Project Manager) for use by the MPTN Projects Department. In addition, the A/E shall provide two (2) CD-ROM’s containing the Project Drawings and Project Manual that comprise the construction documents, and shall submit a written analysis of each of the documents to Owner, pointing out any inaccuracies listed in the respective GMPs.
3.5.2 Architect/Engineer shall furnish to Owner one (1) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, . The CD-ROM drawings as required by BIM this sub-paragraph shall be in an AutoCAD version, and in a format as required by the MPTN Record Drawing Standards. The MPTN project number and name is to be listed on each drawing title block, the cover of the Project Manual, and each individual page of the documents.
3.5.3 After 4.9 The A/E shall provide to the Guaranteed Maximum Price has been acceptedMPTN, Architectfor all projects located outside of the boundaries of the MPTN Reservation, a “Certificate of Substantial Compliance with the Connecticut Building and Fire Safety Codes” bearing original signatures and seals, stating: “This is to certify that the design of the referenced structure is in compliance with the Connecticut Building and Fire Safety Codes adopted by the State of Connecticut, including the following approved modifications of code (list if any).” In the event that the Project is to be constructed on the MPTN Reservation the Certificate shall state: “This is to certify that the design of the referenced structure is in compliance with the MPTN Land Use Commission requirements.” The A/Engineer E shall incorporate into provide the Certificate to the MPTN’s Project Manager when the completed Construction Documents any revisions which documents are necessary submitted to clarify and explain the scope of work included in the Guaranteed Maximum PriceMPTN Land Use Commission for approval.
3.5.4 Architect/Engineer shall assist Owner in connection with Owner's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.

Construction Documents Phase. 3.5.1 Based on the approved Design Development documents previously approved by the Owner and the most recently approved Cost Estimate, including any Owner- approved refinements or clarifications, the Architect/Engineer shall prepare Construction Documents setting forth in detail the quality levels of and any further adjustments in the scope or quality requirements for construction of the Project, and consisting of drawings and specifications that comply with Applicable Laws enacted at the time of their preparation at the location of the Project. After all necessary coordination with the Owner and Project or in Manager, the construction budget authorized by Owner, Architect/Engineer shall prepare, the final Construction Documents, illustrating the scale and relationship of the Project components all of which shall be issued in a form acceptable to the Project Coordinator, for written the Owner’s review and approval, and the approval by of governmental authorities. Refer to Exhibit B for additional information and requirements related to this phase of Services.
(a) The Architect/Engineer shall update the Cost Estimate developed from the Design Development phase, submit such updated estimate to the Owner, “Construction Documents” consisting of drawings and specifications setting forth review the estimate with the Owner to assist in detail analyzing any changes to the requirements for estimated construction cost established by the construction of Cost Estimate submitted in the Project. Architect/Engineer shall submit a minimum of four (4) full size sets of 100% the Construction Documents (signed and sealed), after they have been reviewed and approved by Owner in writing, together with an estimate of Construction Cost. Prior a form acceptable to Construction Manager’s written notice to proceed, Architect/Engineer must submit an Architect/Engineer affidavit to the FIU Department of Building Code Administration to be able to issue the permit to Construction Manager.
3.5.1.1 At the completion of 100% Construction Documents, Construction Manager will prepare a Guaranteed Maximum Price (hereinafter referred to as the “Guaranteed Maximum Price” or “GMP”) proposal based on the 100% Construction Documents prepared by Architect/EngineerOwner. The Architect/Engineer shall resolve with Owner identify in writing for the Owner’s approval
(i) all material changes and deviations that have occurred following the most recently approved Design Development documents, and (ii) any discrepancy between impact on the estimates of Project Schedule and Construction Cost Limitation of which the Architect/Engineer is or should be aware. The Construction Documents shall completely describe all Work necessary to obtain permits and bids for, and to construct, the scope and requirements Project.
(c) The Architect/Engineer, if requested by the Owner, shall prepare the Construction Documents in such order as to permit the Owner to award portions of Owner. the Project under separate construction contracts.
(d) The Architect/Engineer shall assist the Owner in its negotiations with Construction Manager in an effort to develop an acceptable Guaranteed Maximum Price. If Owner does not accept Construction Manager's Guaranteed Maximum Price proposalprepare the necessary bidding information, Architect/Engineer shall cooperate in value engineering with including all documents necessary for bidding or negotiating a construction contract between Owner and Construction Manager to revise Prime Contractor for the Construction Documents as necessary in order to reach an agreement. Architect/Engineer shall analyze each Project, and, if requested by Owner, any Special Conditions of the final Guaranteed Maximum Price documents, and shall submit a written analysis of each of the documents to Owner, pointing out any inaccuracies listed in the respective GMPsconstruction contract.
3.5.2 Architect/Engineer shall furnish to Owner one (1) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, as required by BIM Standards.
3.5.3 After the Guaranteed Maximum Price has been accepted, Architect/Engineer shall incorporate into the Construction Documents any revisions which are necessary to clarify and explain the scope of work included in the Guaranteed Maximum Price.
3.5.4 Architect/Engineer shall assist Owner in connection with Owner's responsibility for filing documents required for the approval of governmental authorities having jurisdiction over the Project.

Construction Documents Phase. 3.5.1 Based on the previously approved Design Development Documents documents and any further adjustments in the scope or quality of the each Project or in the construction budget authorized by the Owner, the Architect/Engineer shall prepare, for written approval by the Owner, “Construction Documents” Documents consisting of drawings Drawings and specifications Specifications setting forth in detail the requirements for the construction of the each Project. The Architect/Engineer shall submit a minimum five (5) sets of seven (7) half-size sets documents and one (1) full-size set of documents, including one (1) set of AutoCAD electronic files and one (1) set of BIM files, as required by BIM Standards, to the Owner for review and approval at 50% completion and then again at 100% completion, together, each time, together with an estimate of Construction Cost. The Architect/Engineer shall submit a minimum of four three (43) full size sets of 100% Construction Documents (signed and sealed), after they have been reviewed and approved by Owner in writing, together with an estimate of Construction Cost. Prior to Construction ManagerBuilder’s written notice to proceed, the Architect/Engineer must submit an Architect/Engineer affidavit to the FIU Department of Building Code Administration to be able to issue the permit to Construction ManagerBuilder.
3.5.1.1 At the completion of 100% Construction Documents, Construction Manager the Builder will prepare a Guaranteed Maximum Construction Price (hereinafter referred to as the “Guaranteed Maximum Price” or “GMP”) proposal based on the 100% Construction Documents prepared by the Architect/Engineer. The Architect/Engineer shall resolve with the Owner any discrepancy between the estimates of Construction Cost and the scope and requirements of the Owner. The Architect/Engineer shall assist the Owner in its negotiations with Construction Manager the Builder in an effort to develop an acceptable Guaranteed Maximum Construction Price. If the Owner does not accept the Construction Manager's Guaranteed Maximum Price proposal, the Architect/Engineer shall cooperate in value engineering with the Owner and Construction Manager the Builder to revise the Construction Documents as necessary in order to reach an agreement. The Architect/Engineer shall analyze each of the final Guaranteed Maximum Construction Price documentsfor each Project, and shall submit a written analysis of each of the documents to the Owner, pointing out any inaccuracies listed in the respective GMPsproposals.
3.5.2 The Architect/Engineer shall assist the Owner in the preparation of the Owner-Builder Agreement, if applicable, and the General Terms and Conditions of the Contract. The Architect/Engineer shall furnish to Owner one (1) complete AutoCAD set of Contract Documents and five (hereinafter defined5) full size sets of each of the final Contract Documents, consisting of construction drawings, technical specifications, construction agreement forms, general conditions, special provisions and one (1) complete set of BIM files, as required by BIM Standardsthe Contract Documents.
3.5.3 After the Guaranteed Maximum each Construction Price has been accepted, the Architect/Engineer shall incorporate into the Construction Documents any revisions which are necessary to clarify and explain the scope of work included in the Guaranteed Maximum each Construction Price.

3.5.2 Architect/Engineer shall furnish to Owner one (1“Construction Proposal Forms” and Agreement(s) complete AutoCAD set of Contract Documents (hereinafter defined) and one (1) complete set of BIM files, as required by BIM Standards.
3.5.3 After the Guaranteed Maximum Price has been accepted, Architect/Engineer which Architect shall incorporate into the Construction Documents.
2. When the construction documents are complete and contain all appropriate information, Architect shall confer with and obtain permit approval from such regulatory agencies as Bureau of Buildings, City Fire ▇▇▇▇▇▇▇▇, Department of Health, Georgia Department of Education. Architect shall check with the applicable regulatory agencies and establish schedule for submission and/or review. Any disapproval from these agencies must be corrected before drawings are released for bidding.
3. Architect shall complete the following tasks:
a. Coordinate the work of all members of the team, including consultants. Coordinate drawings with project specification.
b. Determine what items, if any, are to be furnished by Owner, or are not to be included in the construction contract.
c. Obtain schedule for delivery and installation of Owner-furnished materials.
d. Check all completed documents for coordination, compliance with program, accuracy and cross-coordination with the consultants' and engineers' work, and have them make similar checks.
e. Revise documents if required after check and have consultants and engineers do the same.
f. Place appropriate architect and engineer's seals on the documents and obtain any necessary natures required by reviewing authorities.
4. Construction Documents shall be packaged as prescribed in the Management Plan and be completed in accordance with the Critical Dates Schedule. Inform Owner of any revisions which are necessary to clarify and explain the scope of revisions.
5. Detailed drawings shall cover all work included in the Guaranteed Maximum PriceProject or designated portion thereof.
3.5.4 6. Single or multiple contracts shall be as stated in the Management Plan, and the detailed drawings for each contract shall be prepared by Architect with appropriate designation noted thereon.
7. Specifications shall be prepared using the Construction Specifications Institute (CSI) 16 division format. (On “CD” Disk in fully functional Microsoft Word)
8. Architect shall provide furniture layouts as requested by Owner including but not limited to the following spaces: Science Rooms, Media Center, Cafeteria, and Administration Area.
9. Architect shall provide interior color selection for review and approval by Owner. 10 If requested, Architect shall provide Project Manager copies of in-progress Construction Documents during this phase. Additionally, and in accordance with the Management Plan, Architect/Engineer , at its cost, shall assist Owner in connection with Owner's responsibility submit for filing documents required for approval by Owners two (2) sets of preliminary Construction Documents at the approval stage of governmental authorities having jurisdiction over the Project95% completeness.
