CONSERVATION REQUIREMENTS. Consultant and subcontractor agree to comply with mandatory standards and policies relating to energy efficiency as contained in the state energy conservation plan issued in compliance with the Energy Policy and Conservation Act (42 U.S.C. 6201 et seq).
CONSERVATION REQUIREMENTS. (a) Notwithstanding the foregoing, the services and utilities to be provided by Landlord under this Lease, and the obligations and responsibilities of Landlord in connection therewith, shall be subject to such energy, water or other conservation controls, limitations, or requirements (whether mandatory or voluntary) of general applicability to comparable buildings imposed or issued by applicable governmental agencies or authorities, or public utilities or insurance carriers, including, without limitation, controls, limitations or requirements concerning the permitted range of temperature settings or imposing limitations or restrictions on the volume of energy consumption. If and to the extent required to comply with such energy, water or other conservation controls, limitations, or requirements (whether mandatory or voluntary) of general applicability to comparable laboratory/life-science buildings issued by applicable governmental agencies or authorities, or public utilities or insurance carriers, Landlord shall not be deemed in violation of the terms and conditions of this Lease for the duration of such controls or requirements and the compliance by Landlord with such controls, limitations, or requirements shall not be considered an eviction, actual or constructive, of Tenant from the Premises and shall not entitle Tenant to terminate this Lease or to an abatement or reduction of any rent payable hereunder. Notwithstanding the foregoing, as to any such controls, limitations, or requirements that are voluntary rather than mandatory, the exculpation afforded by the foregoing clauses shall not be applicable unless comparable buildings in Cambridge, Massachusetts have generally instituted similar controls, limitations, or requirements. (b) Landlord shall provide and install bulbs and tubes for Building standard lighting fixtures within the Premises and replacement tubes for such lighting, and the cost of such bulbs and tubes, together with the costs for replacement bulbs and tubes in the premises of other tenants of the Building, shall be included in Expenses; provided, however, (x) the cost of replacement of any specialty bulbs or tubes installed by Landlord at Tenant’s request and the costs of ballasts replaced by Landlord in the Premises shall be paid by Tenant as Additional Rent, and (y) the cost of replacement of specialty bulbs or tubes of other tenants or ballasts replaced in other premises shall not be included in Expenses. CONSERVATION REQUIREMENTS. 4.1 The Tenant shall maintain and provide the spatial accommodation specified in the following table and obtain the prior approval of the Landlord in writing for any proposed change. Any proposed amendment to the CMP shall be submitted to AMO for approval. 4.4 The Tenant shall comply with the conditions stated in the endorsement letter regarding the CMP issued by AMO to the Tenant dated [date] and any other additional requirements as required by the AMO at anytime prior to or after signing of this Agreement.
CONSERVATION REQUIREMENTS. If land that was subject to a contract is re- turned to production of an agricultural com- modity, the conservation requirements under subchapters II and III shall apply to the use of the land to the extent that the requirements are similar to those requirements imposed on other similar land in the area, except that the requirements may not be more onerous than the requirements imposed on other land.

  • Construction Requirements The Contractor shall coordinate with the Irrigation Company prior to beginning any construction that affects the operation or flow of the ditch. Ditch flows for ▇▇▇▇▇ Ditch occur yearlong. Generally, ditch flows for the Picketwire Ditch occur between April 1st – October 15th with additional occurrences in December and March for livestock watering. Working windows for demolition and construction shall be coordinated with the ▇▇▇▇▇ Ditch Company and Picketwire Ditch Company along with their inspectors. The Contractor shall cooperate with the Irrigation Company where Work is within the limits of the Irrigation Company’s property interest and shall perform the Work in such a manner and at such times as not to endanger or interfere with the continuous operation of the canal, property, and the flow of water at or in the vicinity of the Work. No Work shall be performed that interferes with the deeded schedule and volume of flow of the canal, including the delivery of water to its shareholders. The Contractor shall be responsible to the Irrigation Company for all damages for delays that may be sustained by the Irrigation Company caused by any interference that could have been avoided by proper handling of the Work. The Contractor shall obtain Irrigation Company’s approval, in writing, of construction for all of the elements of the Work within the Irrigation Company’s property interest. Copies of such approvals, notices, and correspondence shall be submitted to CDOT for Acceptance prior to beginning any Work on Irrigation Company property interest. The Contractor shall through the owner-controlled insurance program (OCIP) indemnify the Irrigation Company under its insurance coverage during the construction phase. Upon completion of the Work to be performed within Irrigation Company property interest, the Contractor shall promptly remove all tools, Equipment, Materials, and debris from Irrigation Company property placed there by the Contractor or the Contractor’s agents. The Contractor shall restore said property to the same state and condition as when the Contractor entered ▇▇▇▇▇▇▇, and shall leave said property in a clean and presentable condition satisfactory to the Irrigation Company. The Contractor shall provide As-Constructed Documents to the Irrigation Company within 10 Days of completion of Work within the Irrigation Company property interest.

  • Compliance with Nondiscrimination Requirements During the performance of this contract, the Contractor, for itself, its assignees, and successors in interest (hereinafter referred to as the “Contractor”), agrees as follows:

  • Notification Requirements 1. If the Family Leave is foreseeable, the employee must provide the agency/department with thirty (30) calendar days notice of his or her intent to take Family Leave. 2. If the event necessitating the Family Leave becomes known to the employee less than thirty (30) calendar days prior to the employee's need for Family Leave, the employee must provide as much notice as possible. In no case shall the employee provide notice later than five (5) calendar days after he or she learns of the need for Family Leave. 3. For foreseeable leave due to a qualifying exigency, an employee must provide notice of the need for leave as soon as practicable, regardless of how far in advance such leave is foreseeable. 4. When the Family Leave is for the purpose of the scheduled medical treatment or planned medical care of a child, parent, spouse or registered domestic partner, the employee shall, to the extent practicable, schedule treatment and/or care in a way that minimizes disruption to agency/department operations.

  • Information Requirements The Company covenants that, if at any time before the end of the Effectiveness Period the Company is not subject to the reporting requirements of the Exchange Act, it will cooperate with any Holder and take such further reasonable action as any Holder may reasonably request in writing (including, without limitation, making such reasonable representations as any such Holder may reasonably request), all to the extent required from time to time to enable such Holder to sell Registrable Securities without registration under the Securities Act within the limitation of the exemptions provided by Rule 144 and Rule 144A under the Securities Act and customarily taken in connection with sales pursuant to such exemptions. Upon the written request of any Holder, the Company shall deliver to such Holder a written statement as to whether it has complied with such filing requirements, unless such a statement has been included in the Company’s most recent report filed pursuant to Section 13 or Section 15(d) of Exchange Act. Notwithstanding the foregoing, nothing in this Section 7 shall be deemed to require the Company to register any of its securities (other than the Common Stock) under any section of the Exchange Act.
