CONSENT OF THE MORTGAGEE. 21.1 The Mortgagee acknowledges and declares that this Agreement has been entered into by the Owner/Developer with its consent to the intent that the planning obligations shall be binding on the Land and that the security of the Charge over the Land shall take effect subject to this Agreement PROVIDED THAT the Mortgagee shall only be liable for any breach that itself caused whilst mortgagee in possession but shall not be liable for any pre-existing breach] EXECUTED as a deed by the parties and delivered the day and year first before written SCHEDULE 1 AFFORDABLE HOUSING (Part 1)
