Common use of Confirmation of Grant Clause in Contracts

Confirmation of Grant. Subject to the terms of this Agreement, the Company hereby evidences and confirms, effective as of the date hereof, its grant to the Employee of Restricted Stock Units representing the right to receive the number of shares of Common Stock specified on the signature page hereof. This Agreement is entered into pursuant to, and the terms of the Restricted Stock Units are subject to, the terms of the Plan. If there is any conflict between this Agreement and the terms of the Plan, the terms of the Plan shall govern.

Confirmation of Grant. Subject to all of the terms of this Agreement, the Company hereby evidences and confirms, effective as of the date hereofGrant Date, its grant to the Employee Director of Restricted Stock Units representing the right to receive the aggregate number of shares of Common Stock specified set forth on the signature page hereofhereof (the “Shares”). This Agreement is entered into pursuant to, and the terms of the Restricted Stock Units Shares are subject to, the terms of the Plan. If there is any conflict between this Agreement and the terms of the Plan, the terms of the Plan shall govern.

This Agreement is entered into pursuant to, and the terms of the Restricted Stock Units are subject to, the terms of the Plan. If there is any conflict between this Agreement and the terms of the Plan, the terms of the Plan shall govern.

The Options are not intended to be Incentive Stock Options. This Agreement is entered into pursuant to, and the terms of the Restricted Stock Units Options are subject to, the terms of the Plan. If there is any conflict inconsistency between an express provision of this Agreement and the terms an express provision of the Plan, the terms provision of the Plan shall govern.

If there is any conflict inconsistency between an express provision of this Agreement and the terms an express provision of the Plan, the terms provision of the Plan shall govern.

If there is any conflict inconsistency between an express provision of this Agreement and the terms an express provision of the Plan, the terms provision of the Plan shall govern.
