Common use of Confidentiality; Access to Information Clause in Contracts

Confidentiality; Access to Information. (a) The parties acknowledge that Company and Parent have previously executed a Confidentiality Agreement, dated as of December 27, 2000 (the "Confidentiality Agreement"), which Confidentiality Agreement will continue in full force and effect in accordance with its terms.

Confidentiality; Access to Information. (a) The parties acknowledge that Parent and the Company and Parent have previously executed a Confidentiality Agreementletter agreement, dated as of December 27September 22, 2000 2005 (the "“Confidentiality Agreement"”), which Confidentiality Agreement will continue in full force and effect in accordance with its terms, and each of Parent and the Company will hold, and will cause their respective directors, officers, employees, agents and advisors (including attorneys, accountants, consultants, bankers, and financial advisors) to hold any Confidential Information (as defined in the Confidentiality Agreement) confidential in accordance with the terms thereof.

(a) The parties acknowledge that Parent and the Company and Parent have previously executed a Confidentiality Agreementletter agreement, dated as of December 272, 2000 2004 (the "“Confidentiality Agreement"”), which Confidentiality Agreement will continue in full force and effect in accordance with its terms, other than the provisions of paragraph 1 of the Confidentiality Agreement, which are superseded by Section 5.4.

(a) The parties acknowledge that the Company and Parent have previously executed a Confidentiality Agreement, that certain confidentiality agreement dated as of December 27November 14, 2000 2007 between the Company and Parent, as amended to date (the "“Confidentiality Agreement"”), which Confidentiality Agreement will continue in full force and effect in accordance with its terms.

(a) The parties acknowledge that Company and Parent have previously executed a Confidentiality Agreement, dated as of December 27November 24, 2000 1999 (the "Confidentiality Agreement"), which Confidentiality Agreement (except for paragraph 10 thereof, which shall be superseded in its entirety by the provisions of this Agreement) will continue in full force and effect in accordance with its terms.

(a) The parties acknowledge that Company and Parent have previously executed a Confidentiality Agreement, dated as of December 27November 30, 2000 2001 (the "Confidentiality Agreement"), which Confidentiality Agreement will continue in full force and effect in accordance with its terms.

(a) The parties acknowledge that Parent and the Company and Parent have previously executed a Confidentiality Agreementletter agreement, dated as of December 27June 1, 2000 2006 as amended by the Amendment executed by Parent on October 17, 2006 and by the Company on October 19, 2006 (the "“Confidentiality Agreement"”), which Confidentiality Agreement will continue in full force and effect in accordance with its terms, other than those provisions of the Confidentiality Agreement, which are superseded by Section 5.4.
