Common use of COMPETING PROOF Clause in Contracts

COMPETING PROOF. An Instructing Group may request a Guarantor to submit a proof for amounts due to it by the Borrower or any other guarantor. Each Guarantor agrees to submit a proof promptly in accordance with this request if it is entitled to do so. All amounts received in respect of this proof will be held by that Guarantor on trust for the Agent and the Lenders. The obligations in this sub-clause will cease to have effect when the Revolving Facility has ceased to be available and there are no amounts outstanding under this Agreement.
