Common use of Compensation During Disability and Upon Termination Clause in Contracts

Compensation During Disability and Upon Termination. (a) During any period in which Executive fails to perform Executive's duties hereunder as a result of Executive's incapacity due to physical or mental illness or bodily injury or disease, Executive shall continue to receive all Base Salary and other compensation and benefits to which Executive is otherwise entitled under this Agreement and any Plan through Executive's Date of Termination.

(a) During any period in which Executive fails to perform Executive's ’s duties hereunder under this Agreement as a result of Executive's incapacity due to physical or mental illness or bodily injury or diseasea Disability, Executive shall will continue to receive all Base Salary and other compensation and benefits to which Executive is otherwise entitled under this Agreement and under any Plan through Executive's ’s Date of Termination. To the extent the Executive has not received the Base Salary and other compensation and benefits referenced in the preceding sentence prior to the 90th day of a Disability, Executive will receive such Base Salary and other compensation and benefits.

(a) During any period in which Executive fails to perform Executive's duties hereunder as a result of Executive's incapacity due to physical or mental illness or bodily injury or disease, Executive shall continue to receive all an amount which, when coupled with any payments provided to Executive through Employer's disability and other benefit plans, is equivalent to Executive's Base Salary Salary, and other compensation and benefits to which Executive is otherwise entitled under this Agreement and any Plan through Executive's Date of Termination.
