Common use of Collection of Income Clause in Contracts

Collection of Income. Except with respect to Portfolio property released and delivered pursuant to Section 3.2(xiv) or purchased pursuant to Section 2.5(vii), and subject to the last sentence of Section 3.3, the Custodian shall collect on a timely basis all income and other payments with respect to registered Domestic Securities held hereunder to which each Portfolio shall be entitled either by law or pursuant to custom in the securities business, and shall collect on a timely basis all income and other payments with respect to bearer Domestic Securities if, on the date of payment by the issuer, such securities are held by the Custodian or its agent thereof and shall credit such income, as collected, to such Portfolio’s custodian account maintained hereunder. Without limiting the generality of the foregoing, the Custodian shall detach and present for payment all coupons and other income items requiring presentation as and when they become due and shall collect interest when due on securities held hereunder. Income due each Portfolio on securities loaned pursuant to the provisions of Section 3.2 (x) shall be the responsibility of the applicable Fund. The Custodian, in its capacity as custodian hereunder, will have no duty or responsibility in connection therewith, other than to provide the Fund with such information or data as may be necessary to assist the Fund in arranging for the timely delivery to the Custodian of the income to which the Portfolio is properly entitled. The Custodian shall as soon as reasonably practicable notify the Fund in such manner as the Fund and the Custodian may agree in writing if any amount payable to the Fund or other asset of the Fund is not received by the Custodian when due.

The Custodian shall as soon as reasonably practicable notify the Fund in such manner as the Fund and the Custodian may agree in writing if any amount payable to the Fund or other asset of the Fund is not received by the Custodian when due.

The Custodian shall as soon as reasonably practicable notify the Fund in such manner as the Fund and the Custodian may agree in writing if any amount payable to the Fund or other asset of the Fund is not received by the Custodian when due.

Except with respect to Portfolio property released and delivered pursuant to Section 3.2(xiv2.2(14) or purchased and not held pursuant to Section 2.5(vii2.6(7), and subject to the last sentence provisions of Section 3.32.3, the Custodian shall collect on a timely basis all income and other payments with respect to (a) registered Domestic Securities domestic securities held hereunder to which each Portfolio shall be entitled either by law or pursuant to custom in the securities businessbusiness if, on the record date for payment by the issuer, such securities are held hereunder, and shall collect on a timely basis all income and other payments with respect to (b) bearer Domestic Securities domestic securities if, on the date of payment by the issuer, such securities are held by the Custodian or its agent thereof agent, and, with respect to (a) and (b) above, shall credit such income, on the designated settlement date, as collectedpredetermined income, to such Portfolio’s custodian account maintained hereunderaccount. Without limiting the generality of the foregoing, the Custodian shall detach and present for payment all coupons and other income items requiring presentation as and when they become due and shall collect interest when due on securities held hereunder. Income due each Portfolio on securities loaned pursuant to the provisions of Section 3.2 2.2 (x10) shall be the responsibility of the applicable Fund. The Custodian, in its capacity as custodian hereunder, Custodian will have no duty or responsibility in connection therewith, other than to provide the Fund with such information or data as may be necessary to assist the Fund in arranging for the timely delivery to the Custodian of the income to which the Portfolio is properly entitled. The Custodian Fund, or its duly authorized investment manager, shall as soon as reasonably practicable notify the Fund in such manner as the Fund and instruct the Custodian may agree in writing if any amount payable to the regarding all Fund or other asset of the Fund is not received investment manager determinations that a portfolio security has been deemed worthless by the Custodian when duesuch Fund.

Collection of Income. Without limiting the generality of the foregoing, the Custodian shall detach and present for payment all coupons and other income items requiring presentation as and when they become due and shall collect interest when due on securities held hereunder. Income If payment is not received by the Custodian within a reasonable time after proper demands have been made, the Custodian shall so notify the Fund in writing and send copies of all demand letters, any written responses and memoranda of all oral responses to telephonic demands therefor. If, however, the Fund directs the Custodian to maintain securities in "street name", the Custodian shall utilize its best efforts to timely collect income due the Fund on such securities. Collection of income due each Portfolio on domestic securities loaned pursuant to the provisions of Section 3.2 (x2.2(10) shall be the responsibility of the applicable Fund. The Custodian, in its capacity as custodian hereunder, ; the Custodian will have no duty or responsibility in connection therewith, other than to provide the Fund with such information or data in its possession as may be necessary to assist the Fund in arranging for the timely delivery to the Custodian of the income to which the Portfolio is properly entitled. The Custodian shall as soon as reasonably practicable notify the Fund in such manner as the Fund and the Custodian may agree in writing if any amount payable to the Fund or other asset of the Fund is not received by the Custodian when due.

Collection of Income. Without limiting the generality of the foregoing, the Custodian shall detach and present for payment all coupons and other income items requiring presentation as and when they become due and shall collect interest when due on securities held hereunder. Income The collection of income due each Portfolio the Funds on securities Securities loaned pursuant to the provisions of Section 3.2 (x3.9(j) shall be the responsibility of the applicable FundTrust. The Custodian, in its capacity as custodian hereunder, Custodian will have no duty or responsibility in connection therewith, other than to provide the Fund Trust with such information or data as may be necessary to assist the Fund Trust in arranging for the timely delivery to the Custodian of the income to of which the Portfolio each Fund is properly entitled. The Custodian shall as soon as reasonably practicable promptly notify the Fund Trust whenever income due on Securities is not collected in such manner due course and will provide the Trust with monthly reports of the status of past due income. Except as the Fund and set forth herein, the Custodian may agree shall not be required to enforce collection, by legal means or otherwise, of any money or property due and payable with respect to Securities held for a Fund if such Securities are in writing if any amount payable to the Fund default or other asset of the Fund payment is not received by the Custodian when duemade after due demand or presentation.

The Custodian shall credit income to the Portfolio as such income is received or in accordance with Custodian's then current payable date income schedule. Any credit to the Portfolio in advance of receipt may be reversed when the Custodian determines that payment will not occur in due course and the Portfolio may be charged at the Custodian's applicable rate for time credited. Income on securities loaned other than from the Custodian's securities lending program shall be credited as received. Income due each Portfolio on securities loaned pursuant to the provisions of Section 3.2 (x2.2(10) shall be the responsibility of the applicable Fund. The Custodian, in its capacity as custodian hereunder, Custodian will have no duty or responsibility in connection therewith, other than to provide the Fund with such information or data as may be necessary to assist the Fund in arranging for the timely delivery to the Custodian of the income to which the Portfolio is properly entitled. The Custodian shall as soon as reasonably practicable notify the Fund in such manner as the Fund and the Custodian may agree in writing if any amount payable to the Fund or other asset of the Fund is not received by the Custodian when due.

The Custodian shall credit income to the Fund as such income is received or in accordance with Custodian’s then current payable date income schedule. Without limiting the generality of the foregoing, the Custodian shall detach and present for payment all coupons and other income items requiring presentation as and when they become due and shall collect interest when due on securities held hereunder. The CustodianCustodian shall notify a Fund, at the frequency agreed upon by the parties, in its capacity writing by facsimile transmission, electronic communication, or in such other manner as custodian hereundera Fund and the Custodian may agree in writing, if any amount payable with respect to portfolio securities or other assets of the Portfolios of a Fund is not received by the Custodian when due. In the event that extraordinary measures are required to collect such income, a Fund and the Custodian shall consult as to such measures and agree upon any compensation and expenses payable to the Custodian as a result of taking such extraordinary measures. The Custodian shall not be responsible for the collection of amounts due and payable with respect to portfolio securities or other extraordinary assets that are in default. The Custodian will have no duty or responsibility in connection therewith, other than to provide the a Fund with such information or data as may be necessary to assist the a Fund in arranging for the timely delivery to the Custodian of the income to which the Portfolio is properly entitled. The Custodian shall as soon as reasonably practicable notify the Fund in such manner as the Fund and the Custodian may agree in writing if any amount payable to the Fund or other asset of the Fund is not received by the Custodian when due.

The Custodian Fund, or its duly authorized investment manager, shall as soon as reasonably practicable notify the Fund in such manner as the Fund and instruct the Custodian may agree in writing if any amount payable to the regarding all Fund or other asset of the Fund is not received investment manager determinations that a portfolio security has been deemed worthless by the Custodian when duesuch Fund.

Collection of Income. The Custodian, in its capacity as custodian hereunder, Custodian will have no duty or responsibility in connection therewith, other than to provide the Fund with such information or data as may be necessary to assist the Fund in arranging for the timely delivery to the Custodian of the income to which the Portfolio Fund is properly entitled.
