Common use of Code Enforcement Clause in Contracts

Code Enforcement. Developer acknowledges and agrees Agency and the City and their employees and authorized agents shall have the right to conduct code compliance and/or code enforcement inspections of the Housing Development and the individual Affordable Units, both exterior and interior, at reasonable times and upon reasonable notice (not less than 48 hours prior notice) to Developer and/or an individual tenant. If such notice is provided by Agency, City or their representative(s) to Developer, then Developer (or its Property Manager) shall immediately and directly advise tenants of such upcoming inspection and cause access to the area(s) and/or units to be made available and open for inspection. Developer shall include express advisement of such inspection rights within the lease/rental agreements for each Affordable Unit in order for each and every tenant and tenant household to be aware of this inspection right.
