Common use of Claim Determination Clause in Contracts

Claim Determination. Seller shall use commercially reasonable efforts to advise Buyer of Seller’s determination as to whether any claimed defect in any Warranted Part is a valid Warranty Claim within 30 days after the submission of such Warranty Claim. Such determination will be based upon the claim details, reports from the Seller’s Representatives, historical data logs, inspections, tests, findings during repair, defect analysis and other relevant documents.
