SECTION 109 OF THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 The Contractor shall comply with the provisions of Section 109 of the Housing and Community Development Act of 1974. No person in the United States shall on the grounds of race, color, national origin, or sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under this title. Indigenous Peoples 8. The Borrower shall ensure, or cause the Project Executing Agency and Project Implementing Agency to ensure, that the Project does not have any indigenous peoples impacts, within the meaning of the SPS. In the event that the Project or any Subproject does have any such impact, the Borrower shall take, or cause the Project Executing Agency or Project Implementing Agency to take, all steps required to ensure that the Project or Subproject complies with the applicable laws and regulations of the Borrower and with the SPS.
