Indigenous Peoples. 7. The Borrower shall ensure or cause MOWRAM to ensure that the Project does not have any indigenous peoples impact, all within the meaning of the SPS. In the event that the Project does have any such impact, the Borrower shall take all steps required to ensure that the Project complies with the applicable laws and regulations of the Borrower and with the SPS.
Indigenous Peoples. 5. The Borrower shall ensure and cause the Project Executing Agency to ensure that the preparation, design, construction, implementation and operation of the Project comply with (a) all applicable laws and regulations of the Borrower relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; and (c) all measures and requirements set forth in any indigenous people’s plan, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
Indigenous Peoples. 8. The Borrower shall ensure that the Project does not have any indigenous people’s impacts within the meaning of the Safeguard Policy Statement. In the event that a Subproject does have any such impact, the Borrower shall take all steps required to ensure that the Subproject complies with the applicable laws and regulations of the Borrower, the Safeguard Policy Statement and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
Indigenous Peoples ownership and custody of their heritage is collective, permanent, and inalienable as prescribed by the customs, rules, and practices of each people.
Indigenous Peoples. 9. The Borrower shall ensure that the Project does not have any impact on indigenous peoples within the meaning of the Safeguard Policy Statement. In the event that the Project does have any such impact, the Borrower shall ensure or cause the State and the DISCOMs to ensure that the preparation, design, construction, implementation and operation of the relevant Subproject(s) comply with (a) all applicable laws and regulations of the Borrower relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; (c) the IPPF; and (d) all measures and requirements set forth in the relevant IPP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
Indigenous Peoples. 12. The Borrower, through the EA, shall ensure that the preparation, design, construction, implementation and operation of the Project, each Subproject and all Project facilities comply with (a) all applicable laws and regulations of the Borrower relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; (c) the IPPF; and (d) all measures and requirements set forth in the final IPP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
Indigenous Peoples. 10. The Borrower shall cause each Qualified Enterprise to ensure that Qualified Projects do not adversely affect vulnerable groups, such as indigenous peoples, and in the event of any impact or their involvement, the Borrower shall cause each Qualified Enterprise to implement the social safeguards framework as set out in the ESSF in accordance with its terms to ensure compliance with ADB’s Policy on Indigenous Peoples (1998).
Indigenous Peoples. 20. The Borrower shall ensure that the Project will not negatively impact vulnerable groups, such as indigenous peoples. In the unforeseen event that indigenous people are affected by the Project, the Borrower shall ensure that the Project complies with ADB’s Policy on Indigenous Peoples (1998) and all applicable laws and regulations of the Borrower. Indigenous Peoples. The Borrower shall, when applicable in accordance with the provisions of the Indigenous Peoples’ Framework: (a) furnish to the Bank for its approval an Indigenous Peoples’ Plan for each Subproject; and (b) carry out the requirements specified by such Indigenous Peoples’ Plan in accordance with its terms.
Indigenous Peoples. 5. The Borrower shall ensure that Project does not have any impacts on indigenous peoples within the meaning of the SPS. In the event that the Project does have such impacts, the Borrower shall ensure that EA promptly informs ADB and undertakes all necessary steps and measures to comply with applicable laws and regulations of the Borrower and the ADB’s Indigenous Peoples Safeguards.
