Challenged Material Clause Samples
The Challenged Material clause defines the procedures and rights related to content or materials that are disputed, objected to, or legally contested by a third party. Typically, this clause outlines how the parties must respond if material provided under the agreement is alleged to infringe on intellectual property rights or is otherwise challenged, such as by a copyright claim or a takedown notice. Its core function is to allocate responsibility and establish a clear process for addressing and resolving disputes over potentially problematic content, thereby reducing legal risk and ensuring compliance with applicable laws.
Challenged Material. The teacher may challenge through the grievance procedure the factual accuracy of any factual material in the teacher's personnel files other than the regular evaluation documents.
Challenged Material. The Association may appoint one of the two teachers to the Instructional Material Review Committee. The Committee will provide the teacher whose material is being challenged an opportunity to present his or her position with respect to the material to the Committee, in person or in writing. The affected teacher may appeal at any level of the review process.
