Certain Amendment Clause Samples
Certain Amendment. The date set forth in Section 8.1(b) of the Merger Agreement is hereby amended from April 30, 2009 to May 31, 2009.
Certain Amendment. Section 5.09A of the Loan Agreement is hereby amended so as to read in full as follows:
Certain Amendment. Paragraph 2 shall be further amended by adding the words “and Other Posted Support” after each reference to the words “Posted Collateral” in the third and fourth lines. For purposes of Paragraph 2 hereof, the ▇▇▇▇▇▇ shall be deemed to be included in the definition of Posted Collateral.
Certain Amendment. Notwithstanding anything to the contrary in the Purchase Agreement (including Section 2.1), the Purchased Assets shall not include the property and assets described in Schedule A, which shall for all purposes of the Purchase Agreement constitute Excluded Assets.
