C ontrol. Owner Parties shall not be deemed to have control or charge of, and will not be responsible for acts or omissions of, Design-Builder, Subcontractors, or their respective agents or employees, or any other Persons performing Work.
C ontrol. During the Term, Owner shall exercise control over CII and shall retain approval rights over the annual budget, capital expenditures to be made, any disposition of property that is part of the CII, rates to be charged at CII and other matters related to the control and ownership of CII.
