Subject to Section 9.2, Google will defend indemnify, defend, and indemnify hold harmless Customer from and its Afiliates against Indemnified Liabilities in any Third-Party Legal Proceeding to the extent all proven damages, liabilities and costs (including settlement costs with Google’s consent and reasonable attorneys’ fees) arising solely from an Allegation out of a third party claim that use of (a) Google's technology used to provide the Services orinfringes or misappropriates any patent, copyright, trade secret or trademark of that third party.

Google will defend and indemnify Customer and its Afiliates Affiliates against Indemnified Liabilities in any Third-Party Legal Proceeding to the extent arising solely from an Allegation that use of (a) Google's ’s technology used to provide the Services or(excluding any open source software) or (b) any Google Brand Feature infringes or misappropriates the third party’s patent, copyright, trade secret, or trademark.

Google will defend indemnify, defend, and indemnify hold harmless Customer from and its Afiliates against Indemnified Liabilities in any Third-Party Legal Proceeding to all liabilities, damages, and costs (including settlement costs and reasonable attorneys' fees) arising out of a third party claim that the extent arising solely from an Allegation that use of (a) Google's Products or the technology used to provide the Services orinfringes or mis- appropriates any patent, copyright, trade secret or trademark of that third party.
