Building Setback. O2 All buildings and associated structures are adequately setback from the street and side and rear boundaries of the site to: S2.1 A minimum building (including semi and sub- basement car parking) setback of 3 metres to all boundaries is provided. A building setback of at least three (3) metres is achieved to all boundaries, as illustrated by the Architectural Plans forming part of this Site Development Plan, with the exception of the south- eastern corner of the site whereby the carport to the upper floor unit will encroach within this setback. This is considered appropriate in the context of this being an open structure, and being adjacent to the site boundary that interfaces with the adjoining waterbody. There will therefore not be any impact on adjoining premises, nor impact on the public realm given this area (adjoining Lot 700 SP271979) is (a) protect the streetscape character of the local area; (b) ensure there is no significant loss of amenity to residents on adjoining sites; (c) provide separation and spacing between buildings; (d) maintain suitable levels of natural ventilation and light penetration to adjacent properties; and (e) ensure the structural integrity of retaining wall(s) is maintained not intended to be accessible to pedestrians.
Building Setback. Owner agrees that the building setback line of the Burdened Property for permanent installation shall not be less than fifty (50) feet from the center of the Pipeline.
