Common use of Breach of Representation Clause in Contracts

Breach of Representation. Discovery that any representation or warranty made or deemed made by Borrower in this Agreement or in the Note, or any statement or representation made in any certificate, report or opinion delivered pursuant to this Agreement or the Note or in connection with any borrowing under this Agreement by Borrower, was materially untrue when made or deemed made.

Breach of Representation. Discovery by the Lender that any representation or warranty made or deemed made by the Borrower in this Agreement or in the Note, any other Loan Document or in any statement or representation made in any certificate, report or opinion delivered pursuant to this Agreement or the Note other Loan Document or in connection with any borrowing under this Agreement by Borrowerthe Borrower or the Guarantor or any member, manager, officer, agent, employee or director of the Borrower or the Guarantor, was materially untrue when made or deemed to be made.
