Common use of Binding Appointment Clause in Contracts

Binding Appointment. The provisions of this Agreement, including without limitation Article IX hereof, shall be binding upon each Fully-Diluted Stockholder and the executors, heirs, legal representatives and successors of each Fully-Diluted Stockholder, and any references in this Agreement to a Fully-Diluted Stockholder or the Fully-Diluted Stockholders shall mean and include the successors to the Fully-Diluted Stockholders' rights hereunder, whether pursuant to testamentary disposition, the laws of descent and distribution or otherwise.
