Common use of Billable Services Clause in Contracts

Billable Services. 3 34.1 This Article covers situations where an outside organization has requested 4 services of an off-duty Officer, Corporal, or Sergeant. Such services are billed to 5 the outside organization. 6 34.2 Officers, Corporals, and Sergeants covered by this Agreement shall be entitled to 7 compensation for services requested by any outside organization who shall pay 8 for such services. 9 A. A Sergeant shall also be eligible to perform such services as an Officer or 10 Corporal; however, a Sergeant shall not receive preference for such 11 services. 12 B. Unless a separate rate is negotiated in accordance with 34.3 below, and 13 except as provided herein, employees performing services for an outside 14 organization shall be compensated at one and one-half (1½) times his/her 15 respective straight time hourly rate of pay. The compensation to perform 16 services for an outside organization by a Sergeant acting as an 17 Officer/Corporal shall be one and one-half (1½) times the Sergeant’s 18 straight time hourly rate of pay, provided such amount shall not exceed a 19 flat rate of fifty six dollars fifty cents ($56.50). 20 Either party may reopen this section (34.2.B.) one time during the term of 21 this Agreement, upon written notice to the other party. 22 34.3 In contracting for billable services for special large scale events, the City may 23 agree to a rate different than that provided in paragraph 34.2.B. This option shall 24 apply to the University Athletic Association (UAA), Gator Nationals, or ESPN, 25 without notice to the FOP; or other similar vendors upon notice to the FOP. 26 34.4 Hours worked under this Article do not count as hours worked for the purpose of 27 computing overtime in Article 14.
