Bidding and Proposal Phase. 1.5.1 In conjunction with the development of the Guaranteed Maximum Price and at other times as appropriate to the Project, the Architect/Engineer shall assist the Owner and Construction Manager by receiving and recording requests for Bid and Request for Proposal (“RFP”) Documents, receiving and resolving questions about Bid and RFP Documents; preparing addenda, issuing addenda, and accounting for addenda issued; attending pre-bid and pre-proposal conferences and HUB meetings; evaluating bids and proposals; and assisting in preparing and awarding multiple contracts for construction. Architect/Engineer shall answer inquiries from bidders and proposers at Owner’s request, and shall prepare and issue any necessary addenda to the bidding or proposal documents. 1.5.2 The Architect/Engineer shall assist the Construction Manager and Owner in investigating the responsibility of apparent low bidders or proposers and inform Owner in writing of its findings and recommendations. For proposers selected by qualifications and by competitive sealed proposals, the Architect/Engineer shall assist the Construction Manager and Owner in investigating qualifications and other pertinent proposal information and inform the Owner in writing of its findings and recommendations. 1.5.3 In the event the Guaranteed Maximum Price proposal received for the Project exceeds the Final Amount Available for the Construction Contract as approved by the Board of Regents,, if the Architect/Engineer is required to make revisions to the Contract Documents, the Architect/Engineer shall be entitled to compensation, as an Additional Service for changes to the Contract Documents that result from scope changes directed by the Owner that materially impact costs or revisions to the Contract Documents directed by the Owner that resulted in an increase in the AACC. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Final Amount Available for the Construction Contract, if such award is determined by Owner to be in the Owner’s best interest.

For proposers selected by qualifications and by competitive sealed proposals, the Architect/Engineer shall investigate qualifications and other pertinent proposal information and inform the Owner in writing of its findings and recommendations. The Architect/Engineer shall assist the Owner with any contract negotiations with the selected Contractor. 1.5.3 In the event the best value proposal received for the Project exceeds the Final Amount Available for Construction Contract established at the completion of the Construction Document Phase, the Architect/Engineer, without charge to the Owner, and if so directed by Owner, shall revise the drawings and specifications as necessary to bring the cost of the Project within the Final Amount Available for Construction Contract. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Final Amount Available for Construction Contract, if such award is determined by Owner to be in the Owner’s best interest. 1.5.4 The Architect/Engineer shall provide the models and drawings in native file format to all bidders upon request.

Bidding and Proposal Phase. 3.4.1 The A-E shall assist the CM@R in obtaining and evaluating bids or proposals including preparation for and attendance at Pre-bid or Pre-proposal Conferences and HUB meetings. A-E shall answer inquiries from bidders/proposers at CM@R’s request, and shall prepare and issue any necessary addenda to the bidding or proposal documents. The Owner, A-E and CM@R may agree that the Project will be constructed in phases; in that event, the requirements listed below will apply separately to each of two or more different Construction Bid Packages within the Project. 3.4.2 In the event the best value proposal received for the Project exceeds the Final Construction Cost Limitation established at the completion of the Construction Document Phase(s), the A-E, if so directed by Owner, shall revise the drawings and specifications as necessary to bring the cost of the Project within the Final Construction Cost Limitation. If the A/E has not altered the scope or quality level of the project without approval by the ODR, then the A/E will be compensated as an Additional Service for changes to the Construction Documents needed to satisfy Owner’s budget limitations. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Final Construction Cost Limitation, if such award is determined by ODR to be in the Owner’s best interest. The A-E’s Fee will not be adjusted if the Owner decides to accept such a proposal. The A-E shall furnish and deliver to the Owner two compact disks of the complete documents of the Final Revised Construction Documents in a format acceptable by the Owner for the Owner’s record (i.e. all drawings, specifications, product data, cost estimates, etc.).
Bidding and Proposal Phase. 1.6.1 In conjunction with the development of other times as appropriate to the Project, the Project Engineer shall assist the Owner by receiving and recording requests for Bid and Request for Proposal (“RFP”) Documents, issuing Bid and RFP Documents, and accounting for Bid and RFP Documents issued; receiving and resolving questions about Bid and RFP Documents; preparing addenda, issuing addenda, and accounting for addenda issued; attending pre-bid and pre-proposal conferences and HUB meetings; obtaining and evaluating bids and proposals; and assisting in preparing and awarding multiple contracts for construction, including trades and/or subcontractors. Project Engineer shall answer inquiries from bidders and proposers at Owner’s request and shall prepare and issue any necessary addenda to the bidding or proposal documents. 1.6.2 The Project Engineer shall assist the Owner and further and advocate the Owner’s interests in Owner’s negotiations with the successful bidder in an effort to develop a bid proposal offer acceptable to Owner, in Owner’s sole option and discretion. If the Owner does not accept the bid proposal, the Project Engineer shall participate with the Owner in constructability reviews and shall revise the documents as necessary in order to reach an agreement. If bidders proposal exceeds the cost quantity survey furnished to Owner by Project Engineer, and Owner directs Project Engineer to revise the documents, then Project Engineer shall revise the documents at its own expense so that the bid price for constructing the Project shall not exceed the Owner’s Project Budget and any previously approved construction cost estimate. If it is determined to be in the Owner’s best interest, instead of requiring the Project Engineer to revise the drawings and specifications, the Owner reserves the right to accept a bid proposal that exceeds the stipulated Project Budget. The Project Engineer shall analyze the final bid proposal document, together with its supporting assumptions, clarifications, and contingencies, and shall submit a detailed written analysis of the document to the Owner. Such analysis shall include, without limitation, reference to and explanation of any inaccurate or improper assumptions and clarifications. 1.6.3 After the bid proposal has been accepted, the Project Engineer shall incorporate into the Design Development Documents and/or Construction Documents any revisions which are necessary due to inaccurate assumptions and clarification...

For solicitations based upon best value proposals, the Project Architect shall review and inquiry about qualifications and other pertinent proposal information and inform the Owner in writing of Project Architect’s findings and recommendations. 1.5.3 In the event the best value proposal or lowest responsible bid received for the Project exceeds the Construction Cost Limitation following the completion of the Construction Document Phase, the Project Architect, without charge to the Owner, and if so directed by Owner, shall revise the drawings and specifications as necessary to bring the cost of the Project within the Construction Cost Limitation. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the Construction Cost Limitation, if such award is determined by Owner to be in the Owner’s best interest.

If the A/E has not altered the scope or quality level of the Project, then the A-E may be compensated as an Additional Service for changes to the Construction Documents needed to satisfy Owner’s budget limitations. The Owner reserves the right to accept a proposal and award a construction contract that exceeds the final CCL, if such award is determined by ODSR to be in the Owner’s best interest. The A-E’s Fee will not be adjusted if the Owner decides to accept such a proposal.
