Common use of Beyond Repair Clause in Contracts

Beyond Repair. In the event that Leica determined that the cost to repair an instrument exceeds its fair market value, Leica has the right to terminate the Agreement and Leica will refund to Customer the remaining pro-rated amount of the fees already paid during the applicable Contract Period.
