Benefit Leave Clause Samples
The Benefit Leave clause defines an employee's entitlement to take time off from work while still retaining certain employment benefits. Typically, this clause outlines the types of leave covered—such as sick leave, parental leave, or personal days—and specifies the conditions under which benefits like health insurance, retirement contributions, or accrual of seniority continue during the leave period. Its core practical function is to ensure that employees do not lose important benefits when they are temporarily away from work, thereby providing security and clarity for both the employer and employee regarding rights and obligations during leave.
Benefit Leave. A. A member shall receive Benefit Leave by the following formula:
1. A member who has completed one (1) year of employment shall receive twenty-nine (29) days of Benefit Leave per calendar year, with the entire allotment of Benefit Leave days being credited to a member on the first day of each calendar year applicable to this Agreement.
2. One additional day of Benefit Leave per year shall be added at the beginning of the calendar year of the five (5) through twenty-five (25) year anniversary dates of employment.
3. Benefit Leave days under this section shall not exceed fifty (50) days per calendar year.
B. Benefit Leave may be taken subject to approval by the member's supervisor, which shall not be arbitrarily withheld.
C. The minimum amount of Benefit Leave taken at any one time shall be no less than one-half hour, but additional time after the first one-half hour may be used on increments of fifteen (15) minutes.
D. Members of the Uniform Division shall be entitled to carry over up to fifty-one
Benefit Leave. A. A member shall receive Benefit Leave by the following formula:
1. A member who has completed one (1) year of employment shall receive twenty-eight (28) days of Benefit Leave per calendar year, with the entire allotment of Benefit Leave days being credited to a member on the first day of each calendar year applicable to this Agreement.
2. One additional day of Benefit Leave per year shall be added at the beginning of the calendar year of the five (5) through twenty-six (26) year anniversary dates of employment.
3. Benefit Leave days under this section shall not exceed fifty (50) days per calendar year.
B. Benefit Leave may be taken subject to approval by the member's supervisor, which shall not be arbitrarily withheld.
C. The minimum amount of Benefit Leave taken at any one time shall be no less than one-half hour, but additional time after the first one-half hour may be used on increments of fifteen (15) minutes.
D. No accumulated Benefit Leave shall be carried over into the next calendar year.
E. In addition, any member who resigns or retires shall be eligible to receive all Benefit Leave time he or she has already accrued and a credit for the as yet earned Benefit Leave prorated over the entire year by payroll periods and based upon the last day the member is actually present and working. For the purposes of Benefit Leave credit, only sixteen (16) Benefit Leave days are subject to pro-ration. The formula for pro-ration is as follows:

Benefit Leave. 30.01 In the event of the death or serious illness of an immediate family member, a musician may absent himself, without loss of pay or other benefits, for a maximum of five (5) days. If the musician must travel more than five hundred (500) kilometres from Montreal, the maximum is seven (7) days.
Benefit Leave. A. A Benefit Day may be used by notifying the supervisor or other designated personnel of the desire to utilize the Benefit Day. Unit members are encouraged to provide as much notice as possible of the intent to use a Benefit Day.
B. Benefit Days must be used when absent from work until the total is exhausted. Unit members (10 and 12 month) will be charged two (2) days for everyday absent from work the day immediately preceding, or the day immediately following the holidays of Thanksgiving, Christmas, and Spring Break. (With exception of a legitimate written excuse from a medical professional, not to include routine medical/dental appointments with the Superintendent’s approval.)
C. There is no limit on accumulated sick leave. Accumulated sick leave may not be used until a member has exhausted his/her yearly allotment of Benefit Days available. Any half benefit day remaining at the end of a school year will be added to accumulated sick leave. Accumulated sick leave may be used for personal illness or illness in the employee’s immediate family. Immediate family is defined as spouse, child and his/her spouse, mother/step mother, father/step father, brother/step brother, sister/step sister, grandparent/step grandparent, grandchild/▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇, mother-in-law, father-in-law, step-child, ▇▇▇▇▇▇-child, exchange student, and legal dependents.
D. A maximum of three (3) benefit days can be used during the summer session. Accumulated sick leave may be used during the summer session with the Superintendent’s approval, which shall not be unreasonably withheld.
Benefit Leave. A. A member shall receive Benefit Leave by the following formula:
1. A member with less than one (1) year of employment shall receive one (1) day of Benefit Leave for each full calendar month he or she works before the one (1) year anniversary date of his or her employment. Time spent at the Indiana Law Enforcement Academy shall not count as work for purposes of earning Benefit Leave.
