Below Standards Evaluation Clause Samples

The Below Standards Evaluation clause defines the process and criteria for assessing whether a party’s performance falls short of the agreed-upon standards in a contract. Typically, this clause outlines the methods for evaluation, the standards or benchmarks to be used, and the steps to be taken if performance is deemed unsatisfactory, such as providing notice and an opportunity to cure deficiencies. Its core function is to ensure accountability and provide a clear mechanism for addressing subpar performance, thereby protecting the interests of the non-breaching party and maintaining the quality of contractual deliverables.
