Common use of Backorders Clause in Contracts

Backorders. 9.3.1 The CO must be notified in writing by the Consultant within ten (10) days of any and all backordered materials and/or any incomplete services as well as the estimated delivery date. 9.3.2 Unless otherwise stipulated in the Contract, any order that will take more than a maximum of ten (10) days past the original agreed upon delivery date, may at the option of BHA, be canceled and ordered from another source, if, in the opinion of the CO, it is in the best interest of BHA to do so.
