Authority to Terminate Contract. The Department has the authority to terminate a Contractor’s contract and enroll that entity’s participants in other Contractor agencies of the participant’s choosing, or provide their Medicaid benefits through other options included in the State plan, if the Department determines that the Contractor has failed to carry out the substantive terms of the contract.
