Common use of Authority of the District Clause in Contracts

Authority of the District. The District has the full constitutional and lawful right, power and authority, under current applicable law, to execute and deliver and perform the terms and obligations of this Agreement, and the Agreement has been duly and validly authorized and approved by all necessary District proceedings, findings and actions. Accordingly, this Agreement constitutes the legal, valid and binding obligation of the District, enforceable in accordance with its terms.

Accordingly, this Agreement constitutes the legal, valid and binding obligation of the District, enforceable in accordance with its terms. Notwithstanding anything herein to the contrary, the District shall not have the authority to enact a community improvement district sales tax greater than one-half of one percent (0.5%).
