Common use of Assignment of Leases and Contracts Clause in Contracts

Assignment of Leases and Contracts. Four (4) executed counterparts of the Assignment of Leases and Contracts in the form of Exhibit C, and (whether through the closing escrow or through such other method of delivery as the parties may establish) original executed Leases (or copies if originals are not in Seller’s possession) and the Service Contracts which are to be assumed hereunder pursuant to Section 5.6 hereof.

Promptly after Closing, and (whether through outside of the closing escrow escrow, Seller shall deliver to Purchaser or through such other method of delivery as the parties may establish) Purchaser’s designee all original executed Leases (or copies if originals are not in Seller’s possessioncopies) and copies of the Service Contracts which are to be assumed hereunder pursuant to Section 5.6 hereofservice contracts, equipment leases, maintenance agreements and other contracts affecting the Property enumerated in Exhibit F (collectively, the “Contracts”) assigned thereby.
