Common use of Asset Ownership Clause in Contracts

Asset Ownership. Borrower has good and marketable title to all of the properties and assets reflected on the balance sheets and financial statements supplied Lender by Bxxxxxxx, and that all such properties and assets are free and clear of mortgages, security deeds, pledges, liens, charges, and all other encumbrances, except as otherwise disclosed by the financial statements submitted to Lender.

Asset Ownership. Borrower has good and marketable title to all of the their properties and assets assets, reflected on the balance sheets and financial statements supplied Lender by Bxxxxxxxand, and that except for Permitted Encumbrances (as defined below), all such properties and assets are free and clear of mortgages, security deeds, pledges, liens, charges, and all other encumbrances, except as otherwise disclosed by the financial statements submitted to Lender.

The Borrower has good and marketable title to all of the properties and assets reflected on the balance sheets and financial statements supplied Lender Bank by BxxxxxxxBorrower, and that all such properties and assets are free and clear of mortgages, security deeds, pledges, liens, charges, and all other encumbrances, except as otherwise disclosed by the financial statements submitted to Lenderthe Bank, and except for encumbrances on the fee simple interests of properties and assets leased to Borrower pursuant to capitalized leases.
