Applicable Approvals. Concessionaire shall apply and procure all Applicable Approvals in respect of the construction, commissioning and operation of the Regional MSW Facility provided however, any Applicable Approvals that is to be provided by the State Govt shall be granted by State Govt upon the application for the same being made in accordance with applicable law by Concessionaire provided further that in the event State Govt fails to perform its obligation of providing support to Concessionaire for obtaining the Applicable Approvals, then the failure to obtain the relevant Applicable Approvals by Concessionaire shall not be an Concessionaire’s Event of Default under this Concession Agreement.
