Appearance as a Witness. Notwithstanding any other provision of this Article V, the Company may pay or reimburse expenses incurred by a Covered Person in connection with his or her appearance as a witness or other participation in a Proceeding at a time when such Covered Person is not a named defendant or respondent in the Proceeding.

Appearance as a Witness. Notwithstanding any other provision of this Article VIII, the Company may pay or reimburse expenses incurred by the Member, any Director or any Officer in connection with such Member’s, Director’s or Officer’s appearance as a witness or other participation in a Proceeding at a time when such Member, Director or Officer is not a named defendant or respondent in the Proceeding.
Appearance as a Witness. Notwithstanding any other provision of this Article VII, the Company shall pay or reimburse expenses incurred by any Person entitled to be indemnified pursuant to this Article VII in connection with such Person’s appearance as a witness or other participation in a Proceeding at a time when he is not a named defendant or respondent in the Proceeding.
Appearance as a Witness. Notwithstanding any other provision of this Article IX, the Company may pay or reimburse expenses incurred by a Manager in connection with his or her appearance as a witness or other participation in a Proceeding at a time when he or she is not a named defendant or respondent in the Proceeding.
Appearance as a Witness. This section applies to an employee summoned to appear in the employee’s official or non-official capacity in a government case or in official capacity in a private legal action. An employee shall be granted paid court service leave for the hours so spent and shall return to work as soon as practicable after being released. For appearances in state or county courts, an employee shall be reimbursed for expenses by the Judicial Branch pursuant to Article: Expense Reimbursement, and shall not be entitled to receive any fee for service or additional reimbursement. For appearances in federal court, an employee shall be entitled to receive either (a) the appropriate witness fee and witness mileage, or (b) expense reimbursement by the Judicial Branch pursuant to Article: Expense Reimbursement. The provisions of this Article shall not apply to an employee summoned to appear before a court or body as a party to any private legal action which is not job related. In such instances, the employee may use accrued leave time, and may retain any fees paid for service or expenses.
Appearance as a Witness. Notwithstanding any other provision of this Article VII, Holdings LLC may (with the prior approval of the Board) pay or reimburse reasonable out-of-pocket expenses incurred by an Officer, employee or agent in connection with his or her appearance as a witness or other participation in a Proceeding at a time when such Person is not a named defendant or respondent in the Proceeding.
Appearance as a Witness. An employee who is required to appear before a court or other adjudicatory body as a witness, in his/her official capacity as an MainePERS employee, shall be paid for any hours required, including necessary preparation time, waiting time and travel time. If not required to testify after appearing, the employee shall report to work as soon as practicable after being released. If an employee is required to appear before a court or other adjudicatory body as a witness, in his/her official capacity as a MainePERS employee, on a scheduled paid vacation day or other approved paid day off, he/she shall be paid both his/her regular pay and additional pay at his/her regular hourly rate for the hours so spent (including necessary preparation time, waiting time, and travel time), provided that it would not be onerous for the employee to reschedule the day off or impossible to reschedule the court appearance. If the day in question is a flex-time non-work day and rescheduling of the court appearance is impossible the employee shall, at MainePERS’ discretion, either take an alternative flex-time non-work day or be paid both regular pay and additional pay, as above.

Appearance as a Witness. Notwithstanding any other provision of this Article VII, the Partnership, at the sole discretion of the General Partner, may pay or reimburse reasonable out-of-pocket expenses incurred by an Indemnitee, employee or agent in connection with his appearance as a witness or other participation in a Proceeding at a time when he is not a named defendant or respondent in the Proceeding.
Appearance as a Witness. Nurses who are subpoenaed to appear as a witness in a court case, in which neither nurses nor the Association is making a claim against the Medical Center, involving their duties at the Medical Center, during their normal time off duty will be compensated for the time spent in connection with such an appearance as follows: They will be paid their straight-time rate of pay, not including shift differential, provided that the subpoenaed nurse notifies the Medical Center immediately upon receipt of the subpoena. Such pay will not be deemed to be for hours worked. They will also be given, if they so request, equivalent time off from work in their scheduled shift immediately before or their scheduled shift immediately after such an appearance, provided that the subpoenaed nurse makes the request immediately upon receipt of the subpoena.
Appearance as a Witness. An Employee who is required to appear as a witness on behalf of the Board will qualify under the provisions of the preceding paragraph, and will be reimbursed for any reasonable expenses on production of receipts.
