Common use of <Annual Entitlement Capacity Clause in Contracts

<Annual Entitlement Capacity. > The State shall provide sufficient capacity in the transportation facilities, subject to the provisions of Article 17(b), to deliver 11 percent of the Agency’s annual entitlement in each of four months in each year. Subject to the foregoing limitation, in scheduling deliveries under Article 12(a) the State will provide for up to 1/9 of the Agency’s annual entitlement to be delivered in excess of a rate of 8-1/3 percent of the annual entitlement per month.

Subject to the foregoing limitation, in scheduling deliveries under Article 12(a) the State will provide for up to 1/9 22 2/3 of the Agency’s annual entitlement to be delivered in excess of a rate of 8-8 1/3 percent of the annual entitlement per month.

<Annual Entitlement Capacity. > The State shall provide sufficient capacity in the transportation facilities, subject to the provisions of Article 17(b), to deliver 11 percent of the Agency’s annual entitlement in each of four nine months in each year. Subject to the foregoing limitation, in scheduling deliveries under Article 12(a) the State will provide for up to 1/9 24% of the Agency’s annual entitlement to be delivered in excess of a rate of 8-8 1/3 percent of the annual entitlement per month.

<Annual Entitlement Capacity. > The State shall provide sufficient capacity in the transportation facilities, subject to the provisions of Article 17(b), to deliver 11 10 percent (10%) of the Agency’s annual entitlement in each of four 9.6 months in of each year. Subject Provided, That the ten percent (10%) is revised to the foregoing limitation, extent provided in scheduling deliveries under Article 12(a45(d) the State will provide for up to 1/9 of the Agency’s annual entitlement to be delivered in excess of a rate of 8-1/3 percent of the annual entitlement per monththis contract.
