Common use of Annual Capacity of a High Performing Charter School Clause in Contracts

Annual Capacity of a High Performing Charter School. The capacity of a high-performing charter school identified pursuant to s. 1002.331 shall be determined annually by the governing board of the charter school. The governing board shall notify the sponsor of any increase in enrollment by March 1 of the school year preceding the increase. A sponsor may not require a charter school to identify the names of students to be enrolled or to enroll those students before the start of the school year as a condition of approval or renewal of a charter. Pursuant to Section 1002.331(2)(a), Florida Statutes, modification of the contract capacity of a charter school that has been identified as high-performing by the FDOE, shall not exceed the maximum capacity established by any applicable certificate of occupancy, certificate of use, fire permit or applicable provision of Article IX, Section 1 of the Florida Constitution or any other law or rule that is applicable to the School.
